not Received any Part or parcell thereof more then his Debt in John Gallahahs
account that he now Sues for.

John Hawkins, Samuell Magruder

And Further the Said Joshua Cecell for his Client Saith that he did not assume
in manner and forme and therefore putts himselfe upon the Court. Joshua
Cecell.

And the Plantiffe allso. William Stone

Whereupon the truth of the Matter in Controversie betweene the Parties
aforesaid by the Court here being heard understood and maturely deliberated
and the Said John Wheat being Further Examined by the Court it is Considered
that the Said Plantiff and his Pledges be in mercy and Lett the names of the
pledges be Sought for and that the Said John Wheat goe thereof without day etc.

It is Likewise Considered that the Said John Wheate recover against the Said
John Gallahah plantiff the Sume of three hundred and five pounds of Tobacco
his Damages by occation of the premisses by the Discression of the Justices here
to the Said John Wheat Defendant for his Cost and Charges by him in this part
Susteined according to the forme of the Statute etc. by the Court here adjudged.

Willsons Executors Plantiff: Matthew Mackeboy Defendant

The Plantiffe in their Propper persons brought his Majesties writt of Capias
against the Defendant itt being for two Thousand and fifty pounds of Tobacco
due upon account as by Declaration filed and account here Entred may appear
etc.
