Gallahah when he Should be thereunto requested would well and truely Content
and pay Nevertheless although the Said John Wheate hath afterward that is to
Say the 16th of Aprill 1697 Sattisfyed and paid unto the Said John Gallahah
the Sume of 820 lbs. of Tobacco part of the aforesaid Sume of 1780 pounds of
Tobacco but as to the Sume of 960 lbs. of Tobacco residue of the Said Sume of
1780 pounds of Tobacco the Said John Wheate [451] his promise and as-
sumption as aforesaid not at all regarding but mindeing him the Said John
Galahah in this behalfe Craftily and Subtilly to deceive and defraud the Sume
of 960 pounds of Tobacco to the Said John Gallahah hath not paid allthough
the Said John Wheate to doe the Same by the Said John Gallahah afterwards
the day and place aforesaid and Severall other dayes and times was often thereunto
requested but hath hitherto refused and Still doth refuse to the Damage of the
Said John Gallahah of 1800 pounds of Tobacco and thereof hee bringeth his
Suite etc.

And the Said John Wheate by Joshua Cecell his attorney comes and defends
the Force and Injury when etc. and creaveth Lycence thereof to imparle here
untill the next Court and it is Granted unto him the Same Day is given to the
plantiff Likewise Att which day (to witt) the 22d day of August annoque
Domini 1699 came the Said John Gallahah Plantiff as the Said John Wheat by
their attorneyes aforesaid and the Said John Gallahah by William Stone his
Attorney prayeth that the Said John Wheate to his Declaration aforesaid may
answer.

And the Said John Wheate by Joshua Cecell his attorney aforesaid cometh
and defendeth the Force and Injury when etc. and produceth an account against
the Said John Gallahah in Barr against the Debt he the Said John Wheat was
now Sued for (as viz.)
