Sciri Facias, Debt and Cost 5200; Allexander Magruder v. Treacys Administrator
Sciri Facias Debt and Cost 4890.

[408] Thomas Colliar Plantiff: Hugh Reyley Defendant

Hugh Reyley Late of Prince Georges County Planter otherwise called Hugh
Reyley of Callvert County in the Province of Maryland Carpenter was Sumoned
to answer unto Thomas Colliar of a Plea that he render unto him the full and
Just sume of Seven hundred Sixty and five pounds of good Sound Merchantable
Leafe Tobacco and Caske which hee oweth and unjustly deteineth.

And whereupon the Said Thomas Colliar by James Crandford his attorney
Saith that whereas the Said Hugh Reyly the 13th day of January 1693 [1694] by
his certaine Bill of wrighting obligatory Sealed with the Scale of the Said Hugh
and here in Court produced whose date is the day and year aforesaid did binde
himselfe his heires Executors and administrators to Pay or Cause to be paid unto
Thomas Colliar of the Same County Inholder his heires Executors Administrators
or assignes the full and Just Sume of Seven Hundred Sixty and five pounds of
good Sound Merchantable Leafe Tobacco and Caske Convenient in Patuxant
River in the Same County att or upon demand Notwithstanding which the Said
the Said Hugh the Said 765 pounds of Tobacco or any part thereof to the Said
Thomas Colliar hath not Paid although hee hath not Paid although hee hath
been often thereunto required but the Same to pay hath denyed and Still doth
denye to the Damage of the Plantive fourteen Hundred pounds of Tobacco and
thereupon he bringes his Suite.

James Cranford Pledges to Procecute John Doe, Richard Roe.

Whereupon the Said Hugh Reyley by Joshua Cecell his Attorney comes and
defends the force and Injury when etc. and prayeth Lycence thereof to Imparle
here untill the next Court and it is Granted unto him the Same day is Given to
the Plantiff Likewise etc. And now here att this day (to witt) the 28th day of
March 1699 came here as well the Said Thomas Colliar as the Said Hugh Reyley
by their attorneys aforesaid and the Said Thomas Colliar by his Attorney affore-
said prayeth that the Said Hugh to his declaration aforesaid May answer.

Whereupon the Said Hugh Reyley by his Attorney aforesaid cometh and de-
fendeth the force and Injury when etc. and Saith that he is not informed by the
Said Hugh Reyley in the Plea aforesaid and nothing more thereof Saith by which
the Said Thomas Colliar remaineth against the Sayd Hugh Reyley undefended.

Therefore it is Considered that the Said Thomas Colliar Recover against the
Said Hugh Reyley the Sume of Seven Hundred Sixty five pounds of Tobacco his
Debt aforesaid and his Damages by occation of deteineing the Said Debt to two
Hundred thirty two pounds of Tobacco of his Asscent by the Court here adjudged
and the Said Hugh Ryley in mercy.

Wootens Administrator v. Weight and uxor

John Wight Late of Prince Georges County Gentleman and Ann his Wife
Lately Called Ann Gant was atteached to answer unto John Fisher Administrator
of the Goods Chatties and Credditts of Simon Wootton Late of Callvert County
Deceased of a Plea of trespass upon the Case etc.

And whereupon the Said John Fisher by Joshua Cecell his attorney Complein-
eth that whereas the Said Ann Whilst She was Sole (to witt) the 21th day of
June in the year of our Lord 1692 att Callvert County that is to Say att Charles
Towne within the Jurisdiction of this Court Stood indebted unto him the Said
Simon Wooton in his lifetime in the Sume of four pounds Sterling Lawfull money
