[397] His Majesty [v.] Peter Hay
Bee it remembred that the Jurors of our Sovereigne Lord the King for the
body of Prince Georges County upon their Oathes did present Peter Hay of
Mount Callvert Hundred in the County aforesaid did wickedly and prophanely
carry a Gunn on the Sabbath day in ordar to Kill Turkes a Practice quite con-
trary to the good and Knowne Laws of this Province and of the Kingdome of
England, against the tennour and provision of the good Laws of God and this
Province.

And now here att this day (to witt) the 23 day of January Annoque Domini
1698 [1699] this same Court before the Justices of our Sovereigne Lord the King
att Charles Towne came the Said Peter Hay in Custody of the Sheriffe of
Prince Georges County and being brought to barr in his propper person
presently it is demanted how hee would acquitt himselfe of the premisses above
Imposed against him.
And the Said Peter Hay cometh and defendeth the force and Injury when
etc. and Confessing the Fact and for plea Saith that hee Liveing upon a back
plantation carryed the Said Gun for his Safegard alleadgeing he was affraid of
the Indians att that time further adding that if the carrying of a Gunn was
against the Laws of God and this Province hee was Sorry for it and humbly
Submitted himselfe to the Court.
Whereupon all and Singular the premisses by the Court being Seen and under-
stood it is Considered that the Said Peter Hay pay unto our Sovereigne Lord
the King his heires and Successors the Sume of one hundred pounds of Tobacco
and to be bound in a recognizance by Sureties in twenty pounds Sterling Each
of them for his appearance and good beheaviour till the next Court.
And now here at this day (to witt) the 23d day of January 1698 [1699] came
the Said Peter Hay with his Sureties John Browne and Thomas Johnson and
the Said Peter Hay acknowledged himself to be indebted unto our Sovereigne
Lord the King in the full and Just Sume of twenty pounds Sterling money of
England Togather with John Browne and Thomas Johnson his Securities and
the Said John Browne and Thomas Johnson acknowledged themselves to be
Indebted unto our Sovereigne Lord the King in the Sume of tenn pounds Each
of them of like money to be Leavied to be Leavied upon their goods and
Chatties Lands and Tenenements if the Said Peter Hay Shall not appear at the
next County Court to be held att Charles Towne the 4th Tuesday in March
next and in the meantime to bee of good beheaviour as well towards our
Sovereigne Lord the King as all the good people of this province and Espeacially
the Justices and officers of this Court.
Whereas Laurance Rowland Deceased gave unto William Davis Sone of David
Davis Senior a Mare Colt and her increase for Ever the Mother of the Said
William Appeared hear in Court and requested that She might have the
Priveleidge to Swapp or Change the Same for a Cow and Calfe which at that
time was proffered her and it was granted unto her.
