[396] William Groome Plantiff: Mathew Mackeboy Defendant
The Plantiff by Joshua Cecell his attorney Sues the Defendant in a plea of
tresspass upon the Case, it being for Eight hundred twenty nine pounds of
Tobacco due upon the Ballance of accounts f[or] Severall Liquors and ordinary
Accomadations as by Declaration and account filed appeareth And the Deffend-
ant by William Stone his attorney cometh and Deffendeth the Force and Injury
when etc. and Saith that hee did not assume in manner and forme as the Plantiff
in his Declaration Filed as afforesaid hath Sett forth and putts himselfe upon
the Court. William Stone.
And the Plantiffe allso. Joshua Cecell.
The Trueth of the mattar in Controvercy between the Parties aforesaid being
Seen heard and understood and maturely Deliberated it is thereupon Considered
that Plantiff and Defendant have auditors assigned them according to an act of
assembly in such Cases made and Provided that is to Say Mr. Robert Bradley
and Mr. James Stoddart who are hereby ordered to hear and adjust accomps
between the parties aforesaid and that they make repoart thereof to the next
Court to be held here the fourth Tuesday in March next etc. and that in the
mean time the Clerke give a Coppy of the rates of Licquors assest by the Court
to the aforesaid auditors.
William Groome Plantiff: Robert Robertson Defendant
William Groome by by Joshua Cecell his Attorney brought his Majesties writt
of Capias against Robert Robertcon And the Said Robert Robertson in his
propper person cometh and Defendeth the force and Injury when etc. And
Prayeth Leave to have auditors assigned him according to an ordinance of
Assembly in Such Cases made and provided etc. And by the Court auditors are
assigned him that is to Say Mr. Robert Bradley and Mr. James Stoddart who are
hereby ordered to her and adjust accounts between the Partyes aforesaid and
that they make report to the next Court to bee held here the 4th Tuesday in
March next etc. and that in the mean time the Clerke give a Coppy of the rates
of Licquors assest by the Court to the afforesaid auditors.
Hides Executors Plantiff: Nicholas Baker Defendant
The Plantives Sues the Defendant in an Action of Debt for one thousand
Ninety and Eight pounds of Tobacco Due by Bill as by Declaration and bill
Filed appeareth. but hath not Prosecuted their Said writt therefore They and
and their Pledges of Prosecuteing by in Mercy.
Lett the names of the Pledges be Sought and the said Nicholas Baker goe
thereof without day It is Likewise Considered that the Said Nicholas Baker De-
fendant doe recover against the Said Hides' Executors Plantives the Sume of one
hundred and Ninety pounds of Tobacco his Damages by Occation of the
premisses by the Discression of the Justices here To the Said Nicholas Baker
Defendant for his Costs and Charges by him in this Part Susteined according
to the Forme of the Statute etc. by the Court here adjudged, etc.
Archibald Edmundson required that the Following Deed of Guift may be put
upon Record as Viz.
I doe give unto the Edest Sonn of Honnor Davis one brown Cow Calfe
with a White Flank her and all her increase to him and his heires for Ever its
[ears] marked as viz. a hole a Crap and two Slitts on the Right and two Slitts
