Case made and provided etc. [393] and the Said David Small cometh and de-
fendeth the force and Injury when etc. and Saith nothing in bar of the originall
writt aforesaid by which the Said Henry Cullver remaineth against the said David
Small without defence.

Therefore it is Considered that the Said Henry Cullver recover against the
Said David Small the Sume of three thousand two hundred thirty and Six
pounds of Tobacco his Debt aforesaid and his Damages by occation of deteine-
ing the Said Debt to four Hundred and twenty pounds of Tobacco to the
Said Henry Cullver of his asscent by the Court here adjudged and the Said
David Small in Mercy.

of Capias against the Defendant in an action of tresspass upon the Case etc.
