NOVEMBER, 1698 COURT 417

assessed and allso Sixteen Hundred and four pounds of Tobacco to the Said
Joseph Addison att his request for his Cost and Charges in this behalfe Expended
by the Court here adjudged and the Said William Groome in mercy.

This Last Cause between Joseph Addison Plaritiffe and William Groome De-
fendant Mr. Robert Bradly went off the bench.

Then the Court adjourned till to morrow morneing Nine of the Clocke and
then mett and Satt as Followeth.

Mr. Thomas Hollyday, Mr. John Weight, Mr. Robert Bradley, Mr. Robert
Tyler, Mr. Robert Wade, Mr. Samuell Magruder, Mr. John Hawkins, Comis-
sioners.

Paul Beusey was Fined for absenting himselfe from off the Jury two hundred
pound of Tobacco who appeared Presently makeing a reasonable Excuse for so
doeing the Justices remitted his Fine.

Ordered that Mr. Sporne Clear about the Court house in order to Preserve the
Said Court house from Fyer in Consideration for his Trouble he is to have the
wood growing on the Lott of that Land for his trouble.

Thomas Price made oath that hee attended Seven dayes in the Cause between
Addison and Groom he being for Groome it is Ordered that the Said Groome
Pay him afftar the rate of 30 pound of Tobacco per day.

Hugh Treacy made oath that he attended four dayes as an Evidence for
William Groome against Joseph Addison whereupon it was ordared that the Said
Groome pay him for his Said attendance one Hundred and twenty pounds of
Tobacco.

[372] William Wattson made oath that he attended three dayes as an Evidence
for William Young against Charles Hayes whereupon itt was ordered that the
Said William Young Pay the Said Wattson Ninety pounds of Tobacco for his
Said Attendance.

David Hennis desiers his Marke may be recorded as (viz.) an over bitt and
hole on the Right and a hole on the Left.

Joshua Cecell Plantiffe: Ninian Beall Defendant

The Plantiff in his Propper Person brought his Majestys writt of Capias
against the Deffendant in a Plea of Tresspass upon the Case being for the Sume
of two thousand five Hundred Seventy and five pounds of Tobacco upon the
Ballance of accomps as by Declaration Filed and account Tiere entred may
appear.
