to be found in his Bailewick and Likewise have Caused a Coppy of the Declara-
tion and [346] account to be Left at the house where the Defendant last
Lived in this County, it is Likewise testifyed that the Said Defendant hath
alianed him self out of the Jurisdiction of this Court whereupon the Said
Plantive by her attorney aforesaid prayeth an atteachment against the Good
Chatells and Credditts of the Said Defendant for the Sume of three Thousand
one hundred and tenn pounds of Tobacco aforesaid as allso the Sume of Seven
hundred twenty one pounds of Tobacco her Cost and Charges in this behalfe
Layd out and Expended and by the Court it is Granted unto her etc.

John Meriton plantiffe: Daniell Eliott Defendant

The plainetiff in his propper Person brought his Majestyes writt of Capias
against the Defendant for Eight hundred and fifety pounds of Tobacco due by
bill as by Declaration filed appeareth and the defendant Daniell Eliott in his
propper person came into Court and Saith that he cannot gainesay the Debt
aforesaid nor but that he oweth the Said John Meryton the Said Sume of Eight
Hundred and fifty pownds of Tobacco in manner and forme aforesaid etc.

Therefore it is Considered that the Said John Meryton recover against the
Said Daniell Elliott the Sume of Eight hundred and fifety pounds of Tobacco
his Debt aforesaid and his Damages by occation of Deteining the Said Debt to
two hundred and Sixteen pownds of Tobacco to the Said John Meryton of his
assent by the Court here adjudged and the Said Daniell Elliott in mercy etc.

Edward and Dudley Carlton plantiffe: Nicholas Lewis Defendant
The Plantives by Joshua Cecell their attorney Brought his Majestys writt
against the Defendant in a plea of tresspass upon the Case etc. being for four
hundred pounds of Tobacco Due by account as by Declaration filed and account
here Entred may appeare etc.

The Plantiffs by Joshua Cecell their attorney haveing caused a Coppy of the
Declaration and a Coppy of the account by the Sherife delivered to the Defend-
ant att the time of the Serving the writt upon the Said Defendant which was
Eight dayes before the Court Whereupon the Plantives prayeth that the Said
Defendant to his Declaration this Court may answer according to an act of
assembly in that case made and provided etc.

Whereupon the Said Nicholas Lewis in his proper person cometh and de-
fendeth the force and Injury when etc. and Saith that he cannot gaine Say the
action of the Said Edward and Dudley Carleton nor but the four Hundred
pounds of Tobacco is Due and oweing to the Said Edward and Dudley in man-
ner and forme as the Said Edward and Dudley against him hath declared There-
fore it is Considered that the Said Edward and Dudley Carleton recover against
the Said Nicholas Lewis the Sume of four hundred pounds of Tobacco his Debt
aforesaid and their Damages by occation of deteineing the Said Debt to Two
