against the Said John Fry his damages by ocation of the premises to too hundred
Eighty five pounds of Tobacco to the Said Samuell Warren by the Discression
of the Justices here at his request for his Cost and Charges in this behalfe
Susteined according to the forme of the Statute etc. by the Court here adjudged
etc.
Edward Battson Plantiffe: John Davis Defendant
The Plantive by Joshua Cecell his attorney brought his Majestyes Writt of
Capias against the defendant for Six hundred pounds of Tobacco due by Bill
as by Declaration filed appeareth and the Defendant in his propper person
came into Court and Saith that he cannot gainesay the Debt aforesaid nor but
that he oweth the Said Edward Battson the Said Sume of Six Hundred pounds
of Tobbacco in manner and forme aforesaid etc.
Therefore it is Considered that the Said Edward Battson recover against the
Said John Davis the Sume of Six hundred pounds of Tobbacco his Debt afore-
said and his Damages by occation of deteineing the Said Debt to two Hundred
pounds of Tobacco to the Said Edward Battson of his assent by the Court here
adjudged and the Said John Davis in mercy etc.
Edward Battson Plantiffe: William Phillmore Defendant
The Plantive by Joshua Cecell his attorney brought his Majesties Writt of
Capias against the Defendant for Seven hundred pounds of Tobbacco due by
bill as by Declaration and bill filed appeareth and the Said Defendant in his
propper person came into Court and alleaged that there was some Tobacco due
to him from the Plantive since he had passed the foresaid bill, and Saith that
he cannot gainesay the Debt aforesaid nor but that he Passed his Bill to the
plantive for the Sume of Seven hundred pounds of Tobaco in manner and
forme aforesaid etc.
Therefore it is Considered that the Said Edward Battson recover against the
Said William Phillmore The full ballance of the Said Bill he the Said Battson
paying the Said Philmore what is due to him upon account since the Bill was
past, his Debt aforesaid and his Damages by deteineing the Said Debt to two
Hundred pounds of Tobacco to the Said Edward Battson of his assent by the
Court here adjudged and the Said William Phillmore in mercy etc.
