to Say the 2d day of May in the year of our Lord 1692 att Callvert County that
is to Say att Charles Towne within the Jurisdiction of this Court by his
Certaine Bill obligatory which the Said Thomas with the Scale of the Said
Samuell Signed the date whereof is the Same day and year aforesaid the Said
Samuell by the Said bill Obligatory did binde himself his heires Executors
administrators or assignes To Pay or Cause to be Paid to the Said Richard
Charlett his heires Executors administrators or assignes or Lawfull attorney
The full and Just sume of two Thousand two hundred forty and nine pounds
of good Sound Merchantable Leafe Tobacco clear from Trash and Ground
Leaves and Caske to Conteine the Same and to bee Paid att his the Said
Samuells then Dwelling Plantation att or upon all demands after the tenth
day of October next Ensueing the Date of the Said Bill obligatory Notwith-
standing which the Said Samuell allthough often demanded the Said Sume of
2249 lbs. of Tobbacco according to the tennor of the Said bill obligatory to
the Said Richard Charlett in his life time or to the Said Thomas Since the
Death of the Said Richard hath not Paid but the Same to pay to them hath
denyed and as yett the Same to pay to the Said Thomas hath denyed whereupon
the Said Thomas Saith hee is Damnifyed and hath damage to the Value of
4000 pounds of Tobacco and thereupon he brings this Suite etc.

Whereupon the Said Samuell Warren by his Attorney comes and de-
fends the force and Injury when etc. and prayeth Lycence thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given
to the Plantiffe likewise.
And now here att this day (to witt) the 23d day of August Annoque Domini
1698 came here as well the Said Thomas Greenfeild as the Said Samuell Warren
by their Attorneys aforesaid and the Said Thomas Greenfeild prayeth that the
Said Samuell Warren to his Declaration aforesaid may answer.
And the Said Samuell Warren cometh and Defendeth the force and Injury
when etc. and Saith nothing in Barr of the Originall Writt aforesaid by which
the Said Thomas Greenfeild remaineth against the Said Samuell Warren with-
out Defence.
Therefore it is Considered that the Said Thomas Greenfeild recover against
the Said Samuell Warren the Sume of two thousand two hundred forty and
nine pounds of Tobacco his Debt aforesaid and his Damages by occation of
Deteineing the Said Debt to three hundred twenty four pounds of tobacco and
the Said Samuell Warren in Mercy.

Charles Rigby demands a Capias against William Groome in a plea of
Tresspass upon the Case: Warrant to the Sheriffe to arest and returne to the
4th Tuesday of September Annoque Domini 1698. [non Est]
William Liddall demands a Capias against William Groome trespass on the
Case: Warrant and to arrest and returne ut Supra, [non Est]
David Small demands a Capias against John Boyd trespass on the Case:
Warrant etc. to arrest and returne ut Supra. [Countermanded]
