The 4th January 1697 [1698].

Then came before us James Browne and made oath that the within account is
Just and true to the best of his Knowledge and hath received noe part thereof.

And the Said Henry Dryden in his proper person cometh and Defendeth the
force and Injury when etc. and prayeth Lycence to Imparle here untill the next
Court and it is Granted unto him the Same is given to the plantive likewise etc.
And now here at this day (To witt) the 23 day of August 1698 came as well the
Said James Browne by his attorney and Henry Dryden in his propper person
aforesaid and the Said James Browne Prayeth that the Said Henry Dryden to his
Declaration aforesaid may answer etc. And the Said Henry Dryden cometh and
defendeth the force and Injury when etc. and Saith nothing in Barr of the
originall writt aforesaid nor but the account is a Just and true account by which
the Said James Browne remaineth against the Said Henry Dryden without
Defence.

Therefore it is Considered that the Said James Browne recover against the
Said Henry Dryden the Sume of 585 lbs. of Tobaccoe his Debt aforesaid and
his Damages by occation of deteineing the Said Debt 505 pounds of Tobacco and
the Henry Dryden in mercy etc.

Thomas Nellson plantiffe: Charletts Administrator Defendant

Prince Georges County Ss.

Thomas Nellson who brought the writt of our Sovereigne Lord the King
against Mr. Thomas Greenfeild Administrator of all and Singular the Goods
Chattells and Creditts which ware of Mr. Richard Charletts disceased of a plea
of Tresspass upon the Case etc. and hath not prosecuted the Said writt Therefore
hee and his pledges of prosecuteing be in mercy etc. Lett the names of the pledges
be sought etc. and the Said Thomas Greenfeild goe thereof without day and it is
Likewise Considered that the Said Thomas Greenfeild recover against the Said
Thomas Nellson his Damages by occation of the premises to Two hundred Sixty
and five pounds of Tobacco to the Said Thomas Greenfeild by the Discression of
the Justices here at his request for his Cost and Charges in this behalfe Susteined
according to the forme of the Statute etc. by the Court here adjudged.
