AUGUST, 1698 COURT 365

James Waple late of Prince Georges County planter was atteached to answer
unto James Martin of a Plea of Tresspass upon the Case etc.

And whereupon the Said James by William Stone his Attorney compleineth
that whereas the Said James Waple the 20th Day of October in the year of our
Lord 1696 att Charles Towne within the Jurisdiction of this Court Stood Indebted
unto him the Said James Martin in the Sume of Seven Hundred and Eleven
pownds of Tobacco being for Divers Goods Wares and Merchandizes by the Said
James Martin Sold and Delivered the Said James Waple as by a perticular
account thereof here in Court to be produced relation being thereunto had may
more att Large appear, and the Said James Waple to the Said James Martin in
Manner aforesaid being Indebted in Consideration thereof the Said James Waple
did assume upon himselfe and to the Said James Martin then and there faithfully
promise that he the Said James Waple the Said Sume of Seven [336] and
Eleven pounds of Tobacco unto the Said James Martin when he Should be
thereunto Requested would well and truely content and pay nevertheless the
Said James Waple his promise and assumption aforesaid not Regarding but
mindeing and fraudulently Intending him the Said James Martin in this behalfe
Crafetilly and Subtilly to deceive and defraud the Said Sume of Seven Hundred
and eleven pounds of Tobacco or any part thereof according to his promise and
Assumption aforesaid to the Said James Waple to doe the Same by the Said James
Martin afterwards the Day and Place aforesaid was often thereunto requested but
the Same to Pay to the Said James Martin hath denyed and Still Doth denye to
the Damage of the Said James Martin of fourteen hundred pounds of Tobacco
and thereof he brings his Suite etc.
