340 PRINCE GEORGES COUNTY

Whereupon att November Court Last Annoque Domini 1697 Auditors was
Assigned the Said parties to Audite and State Accounts between them (Viz.)
Mr. John Wightt and William Wilkinson as in folio 264 of this booke Ap-
peareth etc. And now here at this day (to witt) the 22d day of March 1697
[1698] Came here as well the Said plantiffe by his Attorney aforesaid as the
Said Defendant in her proper person Likewise Came And the Auditors Assigned
Came and made Report of of theire Audite as [311] Followeth (Viz.) Say
that the[y] find the Estate of Richard Wallis Indebted unto the Estate of
Richard Charlett the Sume of one thowsand five hundred and forty pounds of
tobaccoe Due to ballance upon the bill aforesaid etc.

Therefore it is Considered that the Said Thomas Greenfeild Recover against
the Said Mary Wallis the Sume of one thowsand five hundred and forty pounds
of tobaccoe the ballance due upon the bill Aforesaid and his Damages by Occa-
tion of Deteyning the Said Debt to three hundred forty four pounds of tobaccoe
to the Said Thomas Greenfeild of his Assent by the Court here Adjudged of
the goods and Chatties which were of the Said Richard Wallis at the time of
his Death in the hands of the Said Mary Wallis to be Administred if She hath
Soe much thereof etc. and the Said Mary Wallis in mercy etc.

Edward and Dudley Carleton plantiffe: Henry Crofts Defendant
Prince Georges County Ss. Henry Crofts Late of Prince Georges County
Bricklayer was Attached to Answer unto Edward Carleton and Dudley Carleton
of a plea of trespass upon the Case etc.

And whereupon the Said Edward and Dudley by William Bladen their
Attorney Complaine and Say that whereas the Said Henry the twentith day of
September 1697 att Charles Towne within the Jurisdiction of this Court being
Indebted unto the Said Edward and Dudley in the Sume of Seaventeen hundred
Eighty four pounds of tobaccoe for divers goods and Merchandizes to the Said
Henry at his Spetiall Instance and Request before that time Sold and Delivered
by Capt. William Penn and William Wilkinson gentleman factors of the Said
Edward and Dudley as by a pertickeler Account thereof here in Court brought
may more at Large Appeare And the Said Henry being Soe Indebted the day
yeare and place aforesaid did Assume upon himselfe and to the Said Edward
and Dudley faithfully promise that he the Said Henry the aforesaid Sume of
1784 pounds of tobaccoe unto them the Said Edward and Dudley when he
Should be thereunto Required would well and truly Content and pay Never-
theless the Said Henry his promise and Assumption Soe as Aforesaid made Little
Regarding but plotting and fraudulently Intending them the Said Edward and
Dudley in this behalfe Craftily and Subtilly to Deceive and Defraud the afore-
said Sume of 1784 pounds of tobaccoe unto the Said Edward and Dudley
Although often thereto Required to witt the day yeare and place aforesaid and
at divers times and places before and Since hath not paid but the Same to pay
doth Still denye and Refuse to the Damage of the Said Edward and Dudley
3000 lbs. of tobaccoe and thereupon hee brings this Suite etc.

Pledges to procecute John Doe, Richard Roe. Bladen Attorny pro Querens
Mr. Henry Crofts is Debtor to Edward and Dudley Carleton of London Merchants
(Viz.)
