noate aforesaid but the Said Major Ninian Beall wholly Refused and gain-
sayed to pay the Same or any part thereof Notwithstanding which the Said
Matthew Mockeboy him the Said George Plowden gave Notice of the Refusall
of the Said Major Ninian Beall to pay the Said Noate gave the 12th day of
March 1695 [1696] in the yeare Aforesaid the Said George Plowden his promise
and Assumption Soe as aforesaid made not Regarding but deviseing and Frau-
dulently intending him the Said Matthew Mockeboy of the Said 400 lbs. of
tobaccoe in this behalfe Craftily and Subtilly to deceive and Defraud him the
Said George Plowden the Said 400 lbs. of tobaccoe According to his promise
hath not paid and Sattisfied or given any Content for the Same Although often
thereunto Requested but the Same to pay hath Denyed and Gainsayed to pay
the Same and as yet doth deny and gainsay to the Damage of the plantiffe of
800 lbs. of tobaccoe and thereupon he brings his Suite.

And the Said George Plowden by James Cranford his Attorney Cometh and
Defendeth the force and Injury when etc. prayeth Lycence thereof to Imparle
here untill next Court and it is granted unto him the Same day is given to the
plantiffe Likewise etc.
Att which Said Next Court (to witt) the 22d day of March 1697 [1698]: Came
the Said Matthew Mockeboy by John Meriton his Attorney and prayeth that
the Said George Plowden to his Decleration aforesaid may Answer etc. But the
Said George Plowden Either by himselfe or his Attorney Although Solemly
Called Came not but made Default etc.
Therefore it is Considered that the Said Matthew Mockeboy Recover against
the Said George Plowden as well the Sume of four hundred pounds of tobaccoe
his Debt for Damages aforesaid as allsoe the Sume of two hundred thirty two
pounds of tobaccoe for his Costs and Charges in this behalfe Laid out and
Expended etc. by the Court here Adjudged etc. And the Said George Plowden
in mercy etc.
Zackeriah Alien plantiffe: Thomas Penny and Ann his wife Administratrix
of William Rawlings Defendant
The plantiffe by John Meriton his Attorney brought the writt of our Sover-
eigne Lord the King against the Defendants in a plea that they Render unto
him the Sume of five hundred and two pounds of tobaccoe which from him
they unjustly Deteyneth etc. And hath not procecuted his Said writt to Effect etc.
Therefore hee and his Pledges of procecuteing bee in mercy etc. Lett the
names of the pledges be Sought etc. and the Said Defendants goe thereof with-
out Day etc. It is Likewise Considered that the Said Thomas Penny and Ann
his wife Administratrix aforesaid Recover against the Said Zackeria Alien their
Damages by Occation of the premises to two hundred Eighty nine pounds of
tobaccoe to the Said Defendants by the discretion of the Justices here at their
Request for their Costs and Charges in this behalfe Sustained According to the
forme of the Stattute etc. by the Court here Adjudged etc.

The plantiffe by William Stone his Attorney Sues the Defendant in a plea
that She Render unto him the full and Just Sume of two thowsand Six hundred

Leaves due by bill as by Decleration and bill filed Appeareth etc.
