328 PRINCE GEORGES COUNTY

Mrs. Mary Dove made oath that the bedd ticking in John Coopers Account att
the Suite o£ Charletts Administrator was Delivered and Sold to one John
Upshaw etc.

[300] Whereas William Conley and James Moore became Spetiall [bail] for
Charles Tracey this Court at the Suite of James Brooke for the Sume of four
thowsand Six hundred and Sixty pounds of tobaccoe and at the Suite of
Allexander Magruder for the Sume of four thowsand two hundred pounds of
tobaccoe Whereupon Imediatly After Came the Said Conley and Moore and
delivered the body of the Said Tracey into Court to be delivered up into the
Costody of the Sheriffe for that they will not Stand any Longer Spetiall baile for
the Said Tracey in the Actions Aforesaid Whereupon Came David Small into
Court and offered himselfe to be Spetiall baile for the Said Charles Tracey in
the Said two Actions aforesaid as by the Records following more att Large may
Appeare etc.

Charles Tracey Came into Court and Acknowledged that the Debts Sued for
by James Brookes and Allexander Magruder to this Court are Justly due Where-
upon the Court Ordered that Judgment Should be Entred for the Same. But
Charles Tracey Answered and Said that Judgment ought not to pass against
him this Court for these Reasons following first because this Is but the Appear-
ance Court Secondly because he Could not have any Attorney to plead for him
Except he takes one of the plantiffs Attorney and thirdly that the Decleration
was not Left with him According to Law.

Ordered that Allexander Magruder pay unto Charles Walker ninty pounds
of tobaccoe for his Attendance three dayes against Charles Tracey.

Steven Ashby plantiffe: William Souch Defendant

Command was given to the Sheriffe of Prince Georges County that of the
goods Chatties and Creditts of William Souch he Attach in the hand or hands
of any person and persons in this County the Sume of two thowsand two
hundred and ninteen pounds of tobaccoe or the vallew thereof if Soe much
Shall be found in his baliwick and when he had the Same Attached or any
part thereof the Same in his Custody to keepe Soe that he have the Same before
the Justices of our next Prince Georges County Court to be held at Charles
Towne the fourth Tuesday in March 1697 [1698] And Likewise at the time of
Executeing the Said writt he give notice to all person or persons in whose
hands or possesion he Attach Such goods as aforesaid that they be and Appeare
before the Justices of our Said Court to be held at Charles Towne aforesaid
to Shew Cause if any they have why the goods Soe attached as Aforesaid Should
not be Condemned and Execution thereon had and made etc.

And now here at this day (to witt) the 22d day of March 1697 [1698] Came
the Sheriffe and made Returne of the Said writt Endorsed on the back (Attached
in the hands of the plantiffe four barrells one halfe of Come and twelve
hundred pounds of tobaccoe per me.

Att which day here Came the Said Steven Ashby by William Stone his At-
torney but the Said William Souch Although Solemly Called Came not etc.

Therefore it is Considered that the Said four barrells one halfe of Corne and
twelve hundred pounds of tobaccoe be Condemned in the hands of the Said
