of September in the yeare of our Lord 1693 may Appeare etc. And the De-
fendant in his proper person Cometh and [289] Defendeth the force and
Injury when etc. And prayeth Lycence thereof to Imparle here untill the next
Court and it is granted unto him the Same day is given to the plantiffe Likewise.
And now here at this day (to witt) the 25th day of January Annoque Domini
1697 [1698] Came as well the Said plantiffe by his Attorney aforesaid as the
Said defendant in his proper person And the Said plantiffe prayeth lhat the
Said Defendant to his Decleration aforesaid may Answer etc. And the Said de-
fendant in his proper person Comes and Defends the force and Injury when etc.
And Saith he hath fully Administred all the goods and Chatties which were
of the aforesaid Benjamin Greere at the time of his death in his hands to be
Administred nor had at the time of the Issueing forth the Originall writt of him
the Said Thomas Greenfeild nor at any time after and this he is Ready to
Aver etc. And hereupon for that the Said Defendant the Said Action of the Said
Thomas Greenfeild hath not denyed nor that the Said Joseph Greere is Ad-
ministrator of the goods and Chatties which were of the Said Benjamin Greere
at the time of his death he the Said Thomas Greenfeild prayeth Judgment for
the debt aforesaid to be Levyed of the goods and Chatties which were of the
Said Benjamin Greere to be Administred when to the hands of the Said Joseph
Greere they Shall happen to Come together with his damages by Occaton of
the premises to him to be Adjudged etc.
Therefore it is Considered that the Said Thomas Greenfeild Administrator
aforesaid doe Recover against the Said Joseph Greere the debt aforesaid and
his damages by Occation of Deteyning the Same to the Sume of two hundred
forty four pounds of tobaccoe to the Said Thomas Greenfeild of his Assent by
the Court here Adjudged to be Leavied of the goods and Chatties which were
of the aforesaid Benjamin Greere at the time of his death when to the hands
of the Said Joseph Greere in time to Come Shall happen to Come to be
Administered and the Said Joseph Greere in mercy etc.

gentleman was Attached to Answer unto William Harbert of a plea of trespass
upon the Case etc.
And whereupon the Said William by William Stone his Attorney Complaineth
that whereas the Said Henry on or about the 18th day of Aprill 1696 at Charles
Towne within the Jurisdiction of this Court was Indebted unto the Said William
in the Sume of three thowsand pounds of tobaccoe being for a Certaine parcell
of Land Containing one hundred Acres by the Said William Sold and delivered
to the Said Henry and the Said Henry being Soe Indebted as aforesaid Inconsider-
ation thereof did Assume upon himselfe and to the Said William then and there
Faithfully promise that he the Said Henry the Said Sume of 3000 pounds of
tobaccoe to the Said William when he Should be thereunto Requested would well
and truly Content and pay And Although the Said Henry hath Since Sattisfied
and paid unto the Said William the Sume of 1031 lbs. of tobaccoe part of the
abovesaid 3000 lbs. of tobaccoe Yet as to one thowsand nine hundred Sixty and
nine pounds of tobaccoe Residue of the aforesaid Sume of 3000 lbs. of tobaccoe
the Said Henry his promise and Assumption aforesaid not at all Regarding but
minding and Fraudulently Intending him the Said William in this behalfe
Craftily and Subtilly to Deceive and defraud the Said Sume of 1969 lbs. of
tobaccoe aforesaid the Said William hath not paid Although the Said Henry
