and Creditts of the Said Anthony Smart for the Sume of Six thowsand nine
hundred and twenty pounds of tobaccoe the Debt Sued for when the bill and
Decleration is filed in this Court with the Clerke.
[272] William Sergant by William Stone his Attorney brought his Majesties
writt of Capias against William Elliott in a plea of trespass upon the Case etc.
and the plantiffe haveing Issued out two writts against the Defendant boath
which was by the Sheriffe Returned that the Said Defendant was not to be found
in his balywick Whereupon at the Request of the plantiffes Attorney it is ordered
that the Said William Sergant have an Attachment against the goods Chatties
and Creditts of the Said William Elliot when the Decleration is filed and Ac-
count proved.
Thomas Davis against Roger Yopp.
It was Commanded the Sheriffe that Whereas Thomas Davis Lately in the
Court of our Sovereigne Lord the King in Charles County att Poore [Port]
Tobaccoe the day of before the Justices of our Sovereigne Lord the King
by the Consideration of the Said Court had Recovered against Roger Yopp as
well a Certaine Debt of Six hundred and thirty pounds of tobaccoe as two
hundred thirty Seven pounds of tobaccoe Cost of Suite whereof he was Con-
victed Nevertheless Execution of the Judgment aforesaid yett Remaineth to be
done as by the Insinuation of the Said Thomas Davis our Sovereigne Lord the
King is given to understand and because etc. that by Law etc. he make knowne
to the Said Roger Yopp that he be here att this day that is to Say the 25th day
of January 1697: [1698] to Shew Cause if etc. wherefore the Said Thomas Davis
his Execution against him of the Debt and Damages aforesaid ought not to
have According to the forme of the Recovery aforesaid if etc.
And now here at this Day Came the Said Thomas Davis by William Stone his
Attorney and Offered himselfe against the Said Roger Yopp of the plea aforesaid
and he being Solemly Called Came not etc. And two writts of Scire facias
haveing been Issued out against the Defendant boath which was by the Sheriffe
that the Said Defendant was not to be found in his balywick etc.
Therefore it is Considered that the Said Thomas Davis Recover against the
Said Roger Yopp his Debt: and Damages aforesaid together with two hundred
forty Eight pounds of tobaccoe for his Cost and Charges in this behalfe Sustained
etc.
Henry Jowles against John Bennett
It was Commanded the Sheriffe that whereas there is due to Col. Henry Jowles
from John Bennett three hundred ninty Six pounds of tobaccoe for Clerks fees
in Calvert County and for which Execution hath not yett been Served he make
knowne to the Said John Bennett that he be here att this Day that is to Say
the 25th Day of January 1697 [1698] to Shew Cause if etc. wherefore the Said
Henry Jowles Execution against him of the Debt aforesaid ought not to have etc.
As by the Account filed in the Records of this Court more at Large may
Appeare. And now here at this day Came the Said Henry Jowles in his owne
person and Offered himselfe against the Said John Bennett and he being Solemly
Called Came not. etc.
And the Sheriffe now Returneth that he hath by Lawfull men etc. made
knowne unto the Said John Bennett of his being here this day to Shew Cause in
forme aforesaid etc.
