the Costody of the Sheriffe to answer the Same Whereupon it was ordered by
this Court that the Said Susanah Grimes Remaines in the Custody of the Shefiffe
untill She Shall give good Security to Appeare at the next Court to Answer the
Same.
(This following Action was transmitted out of Calvert County Court).
John Huggins, plantiff: John Bennett Jr. Defendant.
Calvert County Ss.
John Bennett Jr. Late of Calvert County planter was atteched to Answer unto
John Huggins of a plea of trespass upon the Case etc. And Whereupon the Said
John Huggins by Joshua Cecell his Attorney Complaineth tha[t] whereas the
Said John Bennett the tenth day of October in the yeare of our Lord 1694 att
Calvert Towne within the Jurisdiction of this Court was Indebted unto the Said
John Huggins in the Sume of one thowsand pounds of tobaccoe being as well for
Six months Accomedations as alsoe for tobaccoe paid for him the Said John
Bennett and alsoe for Several goods Sold and delivered him the Said John
Bennett as by a pertickeler Account thereof hereunto annexed Relation being
thereunto had may more att Large Appeare and the Said John Bennett to the
Said John Huggins in Manner aforesaid being Indebted Inconsideration thereof
did Assume upon himself and to the Said John Huggins faithfully promise that
he the Said John Bennett him [the] Said John Huggins the Said Sume of 1000
lbs. of tobacco to the Said John Huggins when hee Should be thereunto Re-
quested would well and trust Content and pay Nevertheless the Said John
Bennett his promise and Assumption aforesaid made Little Regarding but
minding and Fraudently Intending him the Said John Huggins in this behalfe
Craftily and Subtilly to deceive and defraude the Said Sume of 1000 lbs. of
tobacco to the Said John Huggins hath not paid Although the Said John
Benne[tt] Afterwards the day and place aforesaid to do the Same by the Said
John Huggins was often thereunt[o] Requested but hath hither to denyed and
Still doth denye to the Damage of the Said John Huggins of 1600 lbs. of tobacco
and thereupon he brings his Suite etc.
Pledges etc. John Doe, Richard Roe. Joshua Cecell for the plantiffe.

And the Said John Bennett by Thomas Hughes his attorney Cometh and
Defendeth the force and Injury when etc. And prayeth Lycence thereof to
Imparle here untill the next Court and itt is granted unto him etc. the Same day
is given to the plantiffe alsoe.
Att which Said next Court (to witt) the fourth Tuesday in August att Charles
Towne in Prince Georges County Came here as well the Said John Huggins as
the Said John Bennett by their Attorneys aforesaid and the Said John Huggins
prayeth thatt the Said John Bennett to his declaration aforesaid may Answer etc.
And the Said John Bennett by his Said Attorney as before (to witt) this fourth
Tuesday in August Annoque Domini 1696 Cometh and defendeth the aforesaid
