NOVEMBER, 1697 COURT 277

The Court Adjourned untill to morrow morning Six a Clock.
Present. Mr. Thomas Hollyday, Mr. William Barton, Mr. John Wighte, Mr.
Robert Tylor, Mr. John Hawkins, Mr. Robert Wade, Mr. Samuell Magruder,
Mr. Thomas Sprigg, Commisoners.

In Obedience to Acts of Assemblys of this province made at a Sessions of
Assembly begun and held at the port of Annopolis the 26th day of May and
Ended the 11th day of June Annoque Domini 1697 the Justices of this Court
hath Caused a Jury of free holders to Appeare before them to Enquier by what
title the Lands on which the Church now built in Charles Towne are held
and the Jury thereon Impannelled being Called Came (Viz.)

John Chittam, foreman, James Brooke, John Cozens, Archable Edmonson,
George Jones, John Forrest, Charles Beven, Thomas Bridges, Allexander
Magruder, Steven Onbee, William Mills, Thomas Stafford, Nathaniell Wickam,
Charles Beall, Joshua Hall, Phillip Gittings, Daniell Daniellson, Thomas
Lucas. Sumoned per Thomas Greenfeild, Sheriffe.

Which Said Jurors haveing taken the Oath as Followeth (Viz) You A: B:
etc. Are to Enquier by what title the Lands on which the Church now built in
Charles Towne are held and to Render an Account thereof to this Court So
help you God.

Upon which the Said Jurors went out to Consider on the premises and in a
Small time Returned And it being by the Court Demanded of them thir
verdict in the premises doe all of them upon their oaths Say that they doe find
the Right of the Lands on which the Church is built in Charles Towne to be
in the Right of Capt. Thomas Emms and Mr. David Small as Least Land from
Mr. William Groome.

Likewise in Obedience to the Acts of Assemblys of this province made at a

[255] Which Said Jurors haveing all taken the Oaths as Followeth (Viz.) You

A: B: etc. Shall well and truly Enquier into the true Value of the Lands Laid

out by the Surveyour of this County for the use of the Church in Charles Towne

According to Act of Assemblys in that Case made and provided (You A: B:

etc. Shall well and truly enquier into the true Value of the Lands Laid out by

the Surveyour of this County for the use of the Court house to be built in

Charles Towne According to Act of Assembly in that Case made and provided

(So help you God) Upon which the Said Jurors went out to Consider on the

premises and in Some Short time Returned and it being by the Court demanded

of them their Verdict in the premises doe all of them upon their oaths Say

(that they doe Allow unto the owner or owners of the Five Acres of Land

Laid out for the use of the Church and Court house in Charles Towne Nine

hundred pounds of tobaccoe for each Acre.

The Court Adjourned for two howers.
