SEPTEMBER, 1697 COURT 271

Act of Assembly in that Case made and provided etc. and of this he puts himselfe
upon the Court.

William Stone. And the plantiffe alsoe. John Meriton.

The truth of the matter in the premises between the parties aforesaid by the
Court here being fully heard understood and Maturely Deliberated It is there-
upon Considered that the Said John Meriton Recover against the Said William
Groome as well the Sume of one pound five Shillings Sterling his Damages in the
premises aforesaid as alsoe the Sume of two hundred fifty Eight pounds of
tobaccoe his Costs and Charges to the Said John Meriton of his Assent by the
Court here Adjudged etc. and the Said William Groome in mercy etc.

George Burgis plantiffe: Guy White Defendant

The plantiffe by Henry Bonner his Attorney brought the writt of our Sover-
eigne Lord the King against Guy White of a plea of trespass upon the Case etc.

And the Said Guy White by William Stone his Attorney Cometh and Defend-
eth the force and Injury when etc. and prayeth Leave thereof to Imparle here
untill the next Court and it is granted unto him the Same day is given to the
plantiffe Likewise.

Att which Said next Court (to witt) the 28th day of September Annoque
Domini 1697 Came here the Said Guy White by William Stone his Attorney But
the Said George Burgis and his Attorney or either of them Altho Solemly Called
Came not by which the Said Guy White Remaineth here by the Said George
Burgis unprocecuted etc. Therefore he and his pledges be in mercy etc. And the
Said Guy White goe thereof without day etc. It is Likewise Considered that the
Said Guy White Recover against the Said George Burgis his damages by Occation
of the premises to two hundred Eighty Seaven pounds of tobaccoe to the Said
Guy White by the Discretion of the Justices here at his Request for his Costs and
Charges in this behalfe Sustained According to the forme of the Statute etc. and
by the Court here Adjudged etc.

[249] John Norris plantiffe: William Hunter Defendant

The plantiffe by Henry Bonner his Attorney brought the writt of our Sover-
eigne Lord the King against the Defendant of a plea of trespass upon the Case etc.

And hath not procecuted his Said writt etc. Therefore he and his pledges of
procecuting be in mercy etc. Lett the names of the Pledges be Sought etc. And
the Said William Hunter goe thereof without day etc.

It is Likewise Considered that the Said William Hunter Recover against the
Said John Norris his Damages by Occation of the premises to two hundred Sixty
five pounds of tobaccoe to the Said William Hunter by the Discretion of the
Justices here at his Request for his Costs and Charges in this behalfe Sustained
etc. According to the forme of the Statute etc. by the Court here Adjudged etc.

Joshua Cecell plantiffe: Richard Hulse Defendant

It was Commanded the Sheriffe that hee Attach the Vallue of fourteen hundred
and four pounds of tobaccoe in the hands of any person or persons in this County
And that he make knowne to Such person or persons in whose hands or possession
hee Attached the Same to Appeare here the fourth Tuesday in June Annoque
Domini 1697 to Shew Cause if any they have why the Said goods Attached in
their hands Should not be Condemned and the Said Joshua Cecell have thereof
Execution etc.

Att which Said day (to witt) the 22d day of June Annoque Domini 1697. Came
