at Charles Towne within the Jurisdiction of this Court Stood Indebted unto the
Said John in the Sume of Eleven hundred and Eighty pounds of tobaccoe being
as well for one years Accomedations as alsoe for Severell Leavies paid for him
the Said Thomas as by a pertickeler Account thereof hereunto Annexed Rela-
tion being thereunto had may more at Large Appeare And the Said Thomas to
the Said John in manner aforesaid being Indebted Inconsideration thereof did
Assume upon himselfe and to the Said John then and there faithfully promise
that he the Said Thomas him the Said John the Said Sume of 1180 lbs. of
tobaccoe when he Should [243] Bee thereunto Requested would well and
truly Content and pay And the Said John in fact Saith that the Said Thomas
in pursuance of his promise and Assumption aforesaid did pay and Sattisfie
unto the Said John the Sume of four hundred pounds of tobaccoe part of the
aforesaid Sume of 1180 pounds of tobaccoe but as to the Sume of Seaven
hundred and Eighty pounds of tobaccoe Ressidue of the Said Sume 1180 lbs.
of tobaccoe aforesaid the Said Thomas his promise and Assumption made as
aforesaid not at all Regarding but minding and fraudulently Intending him
the Said John in this behalfe Craftily and Subtilly to Deceive and Defraud the
Said Sume of 780 pounds of tobaccoe Ressidue of the Said Sume of 1180 lbs.
of tobaccoe to the Said John hath not paid or any Sattisfaction for the Same
made Although the Said Thomas to doe the Same by the Said John Afterwards
the day and place aforesaid was Requested but the Same to pay to the Said
John hath denyed and Still doth denye to the Dammage of the Said John of 1500
lbs. of tobaccoe and thereof he brings his Suite etc.

And the Said Thomas Date by Henry Bonner his Attorney Cometh and De-
fendeth the force and Injury when etc. and prayeth Leave thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given
to the plantiffe etc. At which Said next Court (to witt) the 28th day of Septem-
ber Annoque Domini 1697 Came here the Said John Soper by William Stone
his Attorney But the Said Thomas Date Either by himselfe or Attorney
Although Sollemly Called Came not but made Default etc.
Therefore it is Considered that the Said John Soper Recover against the Said
Thomas Date as well the Sume of Seaven hundred and Eighty pounds of
tobaccoe for his damages in the premises Sustained as Alsoe the Sume of two
hundred thirty Six pounds of tobaccoe for his Costs and Charges in this behalfe
Sustained to the Said John Soper of his Assent by the Court here Adjudged etc.
And the Said Thomas Date in mercy etc.
