264 PRINCE GEORGES COUNTY

said prayeth that the Said Thomas Orton to his decleration aforesaid may
Answer this Court According to Act of Assembly in that Case made and provided
etc.

Uppon which the Said Thomas Orton by William Stone his Attorney Cometh
[242] Here this Court (to witt) the 28th day of September Annoque Domini
1697: And Defendeth the Force And Injury when etc. And Saith that he did
not Assume in manner and forme as the plantiffe in his Decleration aforesaid
hath Complayned and of this he putts himselfe upon the Court by Con-
sent. William Stone. And the plantiffe alsoe. John Meriton.

The truth of the matter in Controversie between the parties aforesaid by the
Court here being Seen heard understood and Maturely deliberated it is there-
upon Considered that the Said Nicholas Sporne Recover against the Said
Thomas Orton as well the Sume of two thowsand five hundred pounds of
tobaccoe his Damages in the premises Sustained as alsoe the Sume of three
hundred Eighty Eight pounds of tobaccoe for his Costs and Charges in this
behalfe Sustained to the Said Nicholas Sporne of his Assent by the Court here
Adjudged And the Said Thomas Orton in mercy etc.

John Forrest plantiffe: Samuell Gibbs Defendant.

Command was given to the Sheriffe that he Attach the Sume of four pounds
Eight Shillings Sterling and 447 lbs. of tobaccoe in the hand or hands of any
person or persons in this County And that hee make knowne to the Said person
or persons that they be here the next Court to be held at Charles Towne the
fourth Tuesday in September next to Shew Cause if any they have why the
goods Attached Should not be Condemned and the Said John Forrest have
thereof Execution etc. Att which Said day the Sheriffe here made Returne of
the Said writt (Endorsed on the back) Attached in the hands of Mr. William
Barton and Sumoned him to Appear etc. per Thomas Greenfeild Sheriffe.

And the Said William Barton here present in Court Saith that [he] hath a
bill of Mr. Thomas Greenfeild in his hands due to the Said Samuell Gibbs for
about fourteen or fifteen hundred pounds of tobaccoe but as for himselfe he
oweth not any thing to the Said Gibbs. And the Said John Forrest by his
Attorney aforesaid prayeth that the Said four pounds Eight Shillings Sterling
may be Reduced into tobaccoe at a penny per pound And by the Court here
it is granted which Comes to one thowsand fifty Six lbs. of tobaccoe.

Therefore it is Considered that as well the Said one thowsand fifty Six pounds
of tobaccoe above Allowed in Lew of the Said four pounds Eight Shillings
Sterling as alsoe the Said Sume of four hundred forty Seaven pounds of tobaccoe
Cost in the whole Amounting to the Sume of fifteen hundred and three pounds
of tobaccoe be Condemned on the Said bill of Thomas Greenfeild due to the
Said Samuell Gibbs in the hands of Mr. William Barton if the Said bill will
amount unto the Said Sume but if the Said bill mentions a Less Sume then for
Soe much as the Said bill doth Express and that the Said John Forres have
Execution for the Same etc.

John Soper plantiffe: Thomas Date Defendant.

Prince Georges County Ss. Thomas Date late of Prince Georges County
Taylor was Attached to Answer unto John Soper of a plea of trespass upon the
Case etc.

And whereupon the Said John by William Stone his Attorney Complaineth
that whereas the Said Thomas the 20th day of October Annoque Domini 1696
