the Same to pay to the Said Thomas doth denye to the damage of the Said
Thomas of 2400 pounds of tobaccoe and thereupon he brings this Suite etc.
Pledges etc. John Doe, Richard Roe. William Stone.
And the Said Thomas brings into Court the Letters Administration etc. by
which it may the plainer Appeare etc.

The plantiffe by his Attorney aforesaid haveing Issued out a writt against the
Defendant which Said writt was by the Sheriffe Returned that the Said De-
fendant was not to be found in his balywick and alsoe have Caused a Coppy
of the Decleration to be Left at the house where the Defendant Last Lived in
this County And Likewise it is testified here in Court that the Said Defendant
hath Elloined himselfe out of the Jurisdiction of this Court etc. Whereupon the
Said Thomas Greenfeild Administrator aforesaid by his Attorney aforesaid
prayeth an Attachment against the goods Chatties and Creditts of the Said
Joseph Letchworth as well for the Said Sume of twelve hundred and fifty
pounds of tobaccoe the ballance of Account aforesaid as alsoe the Sume of four
hundred Sixty Seaven pounds of tobaccoe his Costs and Charges in this behalfe
Laid out and Expended etc. According to Act of Assembly in Such Cases made
and provided etc. And by the Court here it is granted unto him etc.
Richard Charletts Administrator plantiffe: Henry Pope Defendant:
Thomas Greenfeild Administrator of the goods and Chatties of Richard
Charlett Deceased by William Stone his Attorney brought his Majesties writt of
Capias against Henry Pope of a plea that he render unto him the full and Just
Sume of five hundred forty and Seaven pounds of good Sound bright and
Large tobaccoe cleare of trash and ground Leaves and Caske etc. due by bill as
by Declerati[on] and bill filed Appeareth etc. And the Said Henry Pope in his
proper person Cometh and defendeth the force and Injury when etc. And Saith
that he Cannot gainsay the Action of the Said plantiffe nor but the Said bill
(or writeing Obligatory) is the Deed of the Said Henry Pope nor but that he
oweth the Said five hundred forty and Seaven pounds of tobaccoe due by bill
aforesaid in forme as the Said plantiffe hath Declared against him etc.
