tors, Administrators or Assignes the Just quantity of one thowsand pounds of
good Marchantable tobaccoe in Caske to Containe the Same at or neare Mount
Calvert in Prince Georges County Yet the aforesaid. John Little Regarding the
Said bill passed unto the Said Allexander by the Said John but plotting and
fraudulently Intending the aforesaid Allexander in this behalfe Craftily and
Subtilly to deceive and defraud the aforesaid Allexander the aforesaid one thow-
sand pounds of tobaccoe to the aforesaid Allexander hath not as yet paid
Although the aforesaid John by the aforesaid Allexander hath been often there-
unto Required but the Same to him to pay hath Denyed and Still doth Denye to
the Damage of the plantiffe 2000 lbs. of tobaccoe and hereupon he brings his
Suite.

And the Said John Deakins by William Stone his Attorney Cometh and De-
fendeth the force and Injury when etc. and prayeth Leave thereof to Imparle here
untill the next Court and it is granted unto him the Same Day is given to the
plantiffe Likewise etc.

[213] Att which Said next Court (to witt) the 24th day of August Annoque
Domini 1697 Came here as well the Said Allexander Chappell as the Said John
Deekins by theire Attorneys aforesaid and the Said Allexander Chappell prayeth
that the Said John Deekins to his Decleration aforesaid may Answer etc.

And the Said John Deekins by William Stone his Attorney Cometh and de-
fendeth the force and Injury when etc. And Saith that he doth not [owe] the
Said Allexander Chappie the Said one thowsand pounds of tobaccoe in manner
and forme as the plantiffe in his Decleration aforesaid hath Declared and of this
he puts himselfe upon the Country. William Stone.

Therefore it is Commanded the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because as
well etc.

And now here at this day (to witt) the 24th day of August Annoque Domini
1697 here Cometh as well the Said Allexander Chappell as the Said John Deekins
by theire Attorneys aforesaid and the Jurors thereon Impanelled being Called
Likewise Came (Viz.)

Hugh Ryley, foreman, Archable Edmonson, William Conley, John Forrest,

Edward Willett, Allexander Magruder, Joshua Hall, Paul Busey, James Brooke,

Christopher Baines, Robert Orme, Guy White. Supoenaed per Thomas Green-

feild, Sheriffe.

Who to Speake the truth Concerning the premises being Elected tryed and
Sworne doe Say upon their Oath that the Defendant doth not owe to the Said
plantiffe the Said one thowsand pounds of tobaccoe as the Defendant above in
his plea aforesaid hath Alledged.

Upon which the Said Defendant prayeth his Judgment to him by the Court
here on the verdict aforesaid to be Rendered etc. And the Said plantiffe Saith that
the Court here ought not to proceed to Render Judgment upon the verdict afore-
said because he Saith that he hath good Cause to Arrest the Same And prayeth
twenty dayes time to file his Reasons for the Arresting of the Same and it is by
the Court here granted unto him etc.
