AUGUST, 1697 COURT 231

Merchants Resideing in London Should pay to the aforesaid Peter the aforesaid
29 pounds Sterling at twenty dayes Sight and demand made of the Said bill by
the Said James Signed and whereas there is had and from the time of the Contrary
whereof the memory of men is not Extant was had Such a Custome amoungst
Merchants and their factors and Servants used and Approved that if any
Merchant or Merchants or their Factors being in parts beyound the Seas Should
deliver to any other person being in the parts beyound the Seas any Sumes of
money to be paid by any other in the City [210] Of London in the Kingdome
of England by bill of Exchange thereof made and directed to Such person by
whome the Same Sume Should be paid at twenty dayes Sight and Such Like
Merchant to whome Such Sume in the Said bill of Exchange Specified Should be
limited to be paid or any other at the Request of any Servant of Suchlike
Merchant or Merchants within the time Limited for the payment of Such bill of
Exchange Should Come to the useall dwelling house of Such person to whome
the Said bill of Exchange Should be directed to Shew Such person to whome the
bill Should be Soe directed the aforesaid bill of Exchange and to Requier the
Same person to Accept Such bill of Exchange and if Such person to whome the
bill of Exchange aforesaid Should be directed Should not then Accept Such bill
of Exchange as aforesaid And thereupon that bill Should be protested According
to the use of Merchants then in Such Case Such person which Should Soe make
Such bill of Exchange from the whole time aforesaid was Chargeable and ought
to be Charged by Such Merchants to whome Such Sume in Such bill of Exchange
Specified Should be Limited to be paid to pay to Such Merchant to whome the
Same by bill of Exchange Should be limited to be paid Such Sume of money in Such
bill of Exchange Specified if Such person to whome Such bill of Exchange Should
be Soe directed Such Sume of money in Such bill of Exchange Specified to Such
person to whome the Same by Such bill of Exchange Should be limited to be paid
within the time in the Same bill of Exchange for payment thereof Limited Should
not pay And whereas the aforesaid James Ford upon the Recept of goods to the
vallue of twenty nine pounds Sterling the aforesaid 15th day of May 1695 in
Maryland aforesaid for the Consideration aforesaid According to the Custome of
Merchants had delivered to the Said Peter Paggen one first bill of Exchange with
the proper hand and name of the Said James Ford Subscribed and to the Said
Micajah Perry and Company Merchants in London directed Requiring and
Appointing the aforesaid Micajah Perry and Company in and by the Said first
bill of Exchange to pay to the Said Peter Paggen or his order twenty nine pounds
Sterling at twenty dayes Sight of the Said bill then next following the aforesaid
James Ford the Same 15th day of May 1695 Inconsideration of the premises did
Assume upon himselfe and to the Said Peter Paggen faithfully promised that
if the aforesaid bill of Exchange for want of Acceptance thereof by the aforesaid
Macijah Perry and Company Should be protested According to the use of
Merchants of if the Said Micajah Perry and Company the aforesaid twenty nine
pounds Sterling to the Said Peter Paggan or his order did not pay in the end of
twenty dayes then he the Said James the Said £29 Sterling to the aforesaid Peter
Paggen well and faithfully would Content and pay And the Said Peter Paggen
in fact Saith that after and within the aforesaid time in the aforesaid bill of
Exchange for payment thereof limited the aforesaid 29 pounds Sterling to witt on
the 27th day of December Annoque Domini 1695 one Thomas Lawrence Notary
and tabellion Publick etc. then dwelling in London aforesaid at the Request of
the Said Peter Paggen demanded of the Said Micajah Perry to whome and Com-
pany the Said bill was directed if hee would pay the aforesaid bill of Exchange
