man was Attached to Answer unto Thomas Hollyday o£ a plea of trespass upon
the Case etc.

And whereupon the Said Thomas by William Stone his Attorney Complaineth
that whereas the Said Hugh the Second day of January in the yeare of our Lord

1696 att Calvert County that is to Say at Charles Towne within the Jurisdiction
of this Court was Indebted unto the Said Thomas in the Sume of five hundred
pounds of tobaccoe being for the Rent of a Certaine plantation Called Buzard
Iseland Lying in Calvert County for one yeare Ending the day and yeare aforesaid
And the Said Hugh to the Said Thomas in manner aforesaid [209] Being In-
debted Inconsideration thereof did Assume upon himselfe and to the Said Thomas
then and there faithfully promise that he the Said Hugh him the Said Thomas
the Said Sume of 500 pounds of tobaccoe when he Should be thereunto Requested
would well and truly Content and pay Nevertheless the Said Hugh his promise
and Assumption Soe as aforesaid made Little Regarding but minding and Fraudu-
lently Intending him the Said Thomas in this behalfe Craftily and Subtilly to
deceive and defraud the Said Sume of 500 lbs. of tobaccoe or any part thereof to
the Said Thomas hath not paid Although the Said Hugh to doe the Same by the
Said Thomas Afterwards the day and place aforesaid was often thereunto Re-
quested but the Same to pay to the Said Thomas hath denyed and Still doth
Denye to the Damage of the Said Thomas of 1000 lbs. of tobaccoe and thereupon
be brings this Suite etc.

And the Said Hugh Ellis by James Cranford his Attorney Cometh and defend-
eth the force and Injury when etc. And prayeth Leave thereof to Imparle here
untill the next Court and it is granted unto him the Same day is given to the
plantiffe Lickewise.

Att which Said next Court (to witt) the 24th day of August Annoque Domini

1697 here Came as well the Said Thomas Hollyday as the Said Hugh Ellis by
their Attorneys aforesaid and the Said Thomas Hollyday prayeth that the Said
Hugh Ellis to his Decleration aforesaid may Answer etc.

And the Said Hugh Ellis by James Cranford his Attorney Cometh and defend-
eth the force and Injury when etc. and Saith that he is not informed by the Said
Hugh Ellis his Clyant of any Any Answer for the Said Hugh Ellis in the plea
aforesaid to be given and nothing more thereof Saith by which the Said Thomas
Hollyday Remaineth against the Said Hugh Ellis thereof undefended etc.

Therefore it is Considered that the Said Thomas Hollyday Recover against the
Said Hugh Ellis as well the Sume of five hundred pounds of tobaccoe his Damages
in the premises aforesaid as alsoe the Sume of two hundred and twelve pounds of
tobaccoe for his Costs and Charges in this behalfe Sustained to the Said Thomas
Hollyday of his Assent by the Court here Adjudged And the Said Hugh Ellis in
mercy etc.
