AUGUST, 1697 COURT 225
10th day of Aprill Anno 1695 divers goods wares and Merchandizes at Sundry
rates and prizes in tobaccoe the pertickeler whereof are here in Court produced
amounting to the Sume of four hundred and Eight pounds of tobaccoe and
hereunto Annexed the Said William did Assume upon himselfe and to the Said
Daniell and Henry then and there faithfully promise to pay and Sattisfie unto
the Said Daniell and Henry the Said Sume of 408 lbs. of tobaccoe and the Said
Daniell and Henry in fact Saith that the Said William had Received the Said
goods wares and Merchandizes and did Assume and promise as aforesaid Not-
withstanding which the Said William his promise and Assumption Soe as afore-
said made Little Regarding but deviseing and fraudulently intending them the
Said Daniell and Henry the Said Sume of 408 lbs. of tobaccoe Craftily and
Subtilly to deceive and defraud hath not paid Although Often thereunto Re-
quired but the Same to them to pay hath denyed and Still doth denye to the
Damage of the plantiffs 816 lbs. of tobacco and thereupon they bring their Suite.

March 1696/7 Then Came before us Thomas Bale and made his Voluntary
oath that the above Account is Just and true and that him nor any for him hath
Received any part or parcell thereof. John Dorsey, Phillip Howard.
And the Said William Jackson by William Bladen his Attorney Cometh and
Defendeth the force and Injury when etc. and prayeth Leave thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given to the
plantiffe Lickewise etc. Att which Said next Court (to witt) the 24th day of
August Annoque Domini 1697 Came here as well the Said Daniell Juey and
Henry Arthur as the Said William Jackson by their Attorneys aforesaid and the
Said Daniell Juey and Henry Arthur prayeth that the Said William Jackson to
their Decleration aforesaid may Answer etc.
And the Said William Jackson by William Bladen his Attorney Cometh and
defendeth the force and Injury when etc. And Saith that he is not Informed by
the Said William Jackson his Clyant of any Answer for the Said William Jackson
in the plea aforesaid to be given and nothing more thereof Saith by which the
Said Daniell luey and Henry Arthur Remaineth against the Said William
Jackson thereof undefended etc.
Therefore it is Considered that the Said Daniell Iuey and Henry Arthur
Recover against the Said William Jackson as well the Sume of four hundred and
Eight pounds of tobaccoe their Debt for Damages by Account aforesaid as alsoe
the Sume of two hundred forty and four pounds of tobaccoe to the Said Daniell
Iuey and Henry Arthur at their Request for their Costs and Charges in this
behalfe Laid out and Expended etc. And by the Court here Adjudged etc. And
the Said William Jackson in mercy etc.
