224 PRINCE GEORGES COUNTY

Sume of one thowsand nine hundred and forty pounds of tobaccoe Nevertheless
the Said James his promise and Assumption Soe as aforesaid not at all Regard-
ing but minding and fraudulently Intending him the Said John in this behalfe
Craftily and Subtilly to Deceive and defraud the Said Sume of 1940 pounds of
tobaccoe to the Said John hath not paid Although the Said James Afterwards
the day and place aforesaid and at Severall other dayes and times to doe the
Same by the Said John was often thereunto Requested but hath hitherto Refused
and Still doth Refuse to the Damage of the Said John of 2500 pounds of
tobaccoe and thereof he bringeth his Suite etc.

And the Said James Moore by Cleborne Lomax his Attorney Cometh and
defendeth the force and Injury when etc. and prayeth Leave thereof to Imparle
here untill the next Court And it is granted unto him the Same day is given
to the plantiffe Likewise etc.

Att which Said next Court (to witt) the 24th day of August Annoque Domini
1697 Came here as well the Said John Rooke as the Said James Moore by theire
Attorneys aforesaid and the Said John Rooke prayeth that the Said James
Moore to his Decleration aforesaid may Answer etc.

And the Said James Moore by Cleborne Lomax his Attorney Cometh and
defendeth the force and Injury when etc. And Saith that he hath well and truly
paid and Sattisfied the Debt within mentioned and of this hee puts himselfe
upon the Country. Cleborne Lomax

And the plantiffe Alsoe. William Stone.

Therefore it is Commanded the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. And who neither etc. to Recognize etc. because
as well etc. And now here at this day that is to Say the 24th day of August
Annoque Domini 1697: here Cometh as well the Said John Rooke as the Said
James Moore by theire Attorneys aforesaid And the Jurors thereon Impanelled
being Called Likewise Came (Viz.)

Hugh Ryley, foreman, Archable Edmonson, William Conley, John Forrest,

Edward Willett, Allexander Magruder, Paul Busey, John Davis, James Brooke,

Christopher Baynes, Joshua Hall, Robert Orme. Sumoned per Thomas Green-

feild, Sheriffe.

Who to Speake the truth Concerning the premises being Elected tryed and
Sworne doe Say upon their Oaths that they find for the Defendant.

Therefore it is Considered that the Said John Rooke take nothing by his Said
writt but be in mercy for his false Clamor and that the Said James Moore goe
thereof without day etc. It is Likewise Considered that the Said James Moore
Recover against [204] The Said John Rooke his damages by occation of the
premises to nine hundred Seventy three pounds of tobaccoe to the Said James
Moore by the discretion of the Justices here at his Request for his Costs and
Charges in this behalfe Sustained According to the forme of the Stattute etc. And
by the Court here Adjudged etc.

Daniell luey and Henry Arthur plantiffs: William Jackson Defendant.

Prince Georges County Ss. William Jackson late of Prince Georges County
planter was Attached to Answer unto Daniell luey and Henry Arthur in a plea
of trespass upon the Case.

And whereupon the Said Daniell and Henry by John Meriton their Attorney
Complayneth that whereas the Said William Inconsideration the Said Daniell
and Henry had bargained Sold and delivered unto the Said William upon the
