Shall at any time within one yeare and a day Come here and Appeare to the
Said Originall Action against him and make it Appeare that the Said Edward
Willett hath been and is Sattisfied his Demand aforesaid or Shall otherwise in this
Court discount or barr the Said Edward Willett of the Same or any part thereoff
etc.
John Carmalt plantiffe: Robert Jones Defendant.
Prince Georges County Ss. Robert Jones late of Prince Georges County
planter was Attached to Answer unto John Carmalt of a plea of trespass upon
the Case etc.
And Whereupon the Said John by Cleborne Lomax his Attorney Complayneth
that whereas the Said John the tenth day of May in the yeare of our Lord 1697
at Piscattaway within the Jurisdiction of this Court at the Espetiall Instance and
Request of him the Said Robert did [197] Lend and deliver unto him the
Said Robert one Saddle of the Vallue of three hundred lbs. of tobaccoe for the
Space of two or three dayes and then to be Returned againe to him the Said
John Inconsideration whereof the Said Robert did Assume upon himselfe and to
the Said John then and there faithfully promise that he the Said Robert the Said
Saddle at the End of two or three dayes as aforesaid would well and truly Deliver
and Returne againe to him the Said John Nevertheless the Said Robert his
promise and Assumption aforesaid not Regarding but minding and fraudulently
Intending him the Said John in this behalfe Craftily and Subtilly to deceive and
defraud the Said Saddle to him the Said John at the End of two or three dayes
as aforesaid nor at any time afterwards hath not delivered and Returned Al-
though the Said Robert to doe the Same by the Said John Afterwards the day
and place aforesaid was Requested but hath hitherto Refused and Still doth
Refuse to the damage of the Said John of Seaven hundred pounds of tobaccoe
and thereof hee bringeth his Suite etc.

The plantife by his Attorney aforesaid haveing Issued out a writt against the
Defendant which Said writt was by the Sherife of Prince Georges County Re-
turned that the Said Defendant was not to be found in his balywick and alsoe
have Caused a Coppy of the Decleration to be Left at the house were the De-
fendant last Lived in this County And Likewise it is testified here in Court on
part of the Said plantife that the Said Defendant hath Elloined himselfe out of
the Jurisdiction of this Court.
Whereupon the Said John Carmalt by his Attorney aforesaid prayeth an
Attachment against the goods Chatties and Creditts of the Said Robert Jones as
well for the Said Sume of three hundred pounds of tobaccoe the Debt for Dam-
ages aforesaid as alsoe the Sume of four hundred and thirteen pounds of tobaccoe
his Cost and Charges in this behalfe Laid out and Expended etc. According to
Act of Assembly in Such Cases made and provided etc. And the Said Request of
the Said John Carmalt by the Court here is granted unto him etc.

Prince Georges County Ss. Richard Edwards late of Prince Georges County
planter otherwise Called Richard Edwards of Calvert County planter was Sum-
oned to Answer unto Edward Batson of a plea that he Render unto him the full
Sume of four hundred pounds of good Sound large Bright and dry leafe tobaccoe
and Caske to Containe the Same which to him he oweth and unjustly Deteyneth
etc.
