And the Said Thomas Davis by William Stone his Attorney Cometh and de-
fendeth the force and Injury when etc. and prayeth leave to Imparle here untill
the next Court and it is granted unto him the Same day is given to the plantiffe
Likewise etc.
Att which Said next Court (to witt) the 22d day of June Annoque Domini
1697: Came here as well the Said Ninian Beall as the Said Thomas Davis by their
Attorneys aforesaid and the Said Ninian Beall prayeth that the Said Thomas
Davis to his decleration aforesaid may Answer etc.
And the Said Thomas Davis by William Stone his Attorney Cometh and de-
fendeth the force and Injury when etc. and Saith that the Said Thomas Davis
have paid the Said five hundred and twenty pounds of tobaccoe in the Declera-
tion mentioned and of this he puts himselfe upon the Court etc.
William Stone. And the plantiffe alsoe. John Meriton.
Whereupon the truth of the matter in Controversie between the parties afore-
said by the Court here being fully heard understood and Maturely Deliberated
etc. It is thereupon Considered that the Said Ninian Beall Recover agains[t] the
Said Thomas Davis as well the Sume of four hundred and twenty one pounds of
tobaccoe the Debt for Damages aforesaid as alsoe the Sume of two hundred forty
Eight pounds of tobaccoe the the Said Ninian Beall att his Request for his Cost
and Charges in this behalfe Laid out and Expended And by the Court here
Adjudged etc. And the Said Thomas Davis in mercy etc.
William Groome plantiffe: Charles Tracey Defendant
The plantiffe brought the writt of our Sovereigne Lord the King against
Charles Tracey late of Prince Georges County Inholder of a plea of trespass
[189] Upon the Case etc. And hath not procecuted his Said writt etc. therefore
he and his pledges of procecuteing be in mercy etc. Lett the names of the pledges
be Sought etc. And the Said Charles Tracey goe thereof without Day etc. It is
Likewise Considered that the Said Charles Tracey Recover against the Said
William Groome his Damages by Occation of the premises to two hundred Sixty
five pounds of tobaccoe to the Said Charles Tracey by the Discretion of the
Justices here at his Request for his Costs and Charges in this behalfe Sustained
According to the form of the Statute etc. by the Court here Adjudged etc.
Mordicay Moore Executor of John Swallwell plantiffe: James Stoddart De-
fendant
The plantiffe brought his Majesties writt against the Defendant in a plea of
trespass upon the Case etc. And hath not procecuted his Said writt etc. therefore
hee and his pledges of procecuteing be in mercy etc. Lett the Names of the
pledgers be Sought etc. And the Said James Stoddart goe thereof without day etc.
It is Likewise Considered that the Said James Stoddart Recover against the Said
Mordicay Moore his Damages by Occation of the premises to Seaven hundred
thirty five pounds of tobaccoe to the Said James Stoddart by the discretion of the
Justices here at his Request for his Costs and Charges in this behalfe Sustained
According to the forme of the Statute etc. by the Court here Adjudged etc.
If it please your worships all that I have to Say is that I made up the Account
