Therefore it is Commanded the Sheriffe that without Delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because
as well etc. And now here at this day that is to Say the 22d day of June Annoque
Domini 1697 here Cometh as well the Said Christopher Baynes as the Said
Joseph Addison by theire Attorneys aforesaid and the Jurors thereon Impanelled
being Called Likewise Came (Viz.)
James Stoddart, foreman, Hugh Ryley, John Browne, John Cozens, William
Selby, Archable Edmonson, James Moore, Edward Willett, Francis Marbery,
William Rothery, John Chittam, Joseph West. Sumoned per Thomas Green-
feild, Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne Doe Say upon their oath that the Said Defendant doth owe to the Said
Christopher Baynes Executor aforesaid the Said Six hundred pounds of tobaccoe
as the plantiffe above in his Decleration hath declared etc.
Therefore it is Considered that the Said Christopher Baynes Executor afore-
said Recover agains[t] the Said Joseph Addison the Sume of Six hundred pounds
of tobaccoe his debt aforesaid by the Jurors aforesaid in forme aforesaid Assessed
And his Damages by Occation of Deteyning the Said Debt Six hundred Seaventy
Eight lbs. of tobaccoe to the Said Christopher Baynes Executor aforesaid of his
Assent by the Court here Adjudged And the Said Joseph Addison in mercy etc.
Ninian Beall plantiffe: Thomas Davis Defendant
Prince Georges County Ss. Thomas Davis late of Prince Georges County
planter was Attached to Answer unto Ninian Beall of a plea of trespass upon the
Case etc.
And whereupon the Said Ninian by John Meriton his Attorney Complayneth
that whereas the Said Thomas the 20th day of September in the yeare of our
Lord 1695 at Calvert County that is to Say at Charles Towne within the Jurisdic-
tion of this Court was Indebted unto the Said Ninian in the Sume five hundred
and twenty lbs. [188] Of tobaccoe being as well for Leavies and the ballance of
a former Account as alsoe for tobaccoe paid for him the Said Thomas as by a
pertickeler Account thereof here in Court produced Relation being thereunto had
may more at large Appeare and the Said Thomas to the Said Ninian in manner
aforesaid being Indebted Inconsideration thereof did Assume upon himselfe and
to the Said Ninian then and there faithfully promise that he the Said Thomas
him the Said Ninian the Said Sume of 520 lbs. of tobaccoe when he Should be
thereunto Requested would well and truly Content and pay Nevertheless the
Said Thomas his promise and Assumption Soe as aforesaid made Little Regarding
but mindeing and fraudulently Intending him the Said Ninian in this behalfe
Craftily and Subtilly to deceive and Defraud the Said Sume of 520 lbs. of tobaccoe
or any part thereof to the Said Ninian hath not paid Although the Said Thomas
to doe the Same by the Said Ninian Afterwards the day and place aforesaid was
often thereunto Requested but the Same to pay hath Denyed and Still doth
Denye to the Damage of the Said Ninian of 1000 lbs. of tobaccoe and thereof he
brings his Suite etc.
