And the Said Edward Batson by John Meriton his Attorney Cometh and
defendeth the force and Injury when etc. and prayeth leave thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given to
the plantiffe Lickewise and Att which Said next Court (to witt) the 22d day of
June Annoque Domini 1697: Came as well the Said Edward and Dudley Carle-
ton and Company as the Said Edward Batson by theire Attorneys aforesaid And
the Said Edward and Dudley Carleton and Company prayeth that the Said
Edward Batson to their Decleration aforesaid may Answer etc. And the Said
Edward Batson by John Meriton his Attorney Cometh and defendeth the force
and Injury when etc. And Saith that he did not Assume in manner and forme
as the Said Edward and Dudley against him hath Complayned and thereof hee
puts himselfe upon the Country. John Meriton.

Therefore it is Commanded the Sheriffe that without delay hee Cause to
Come here twelve etc. by whome etc. and who neither etc. to Recognize etc.
because as well etc. And now here at this day that is to Say the 22d of June
Annoque Domini 1697: here Cometh as well the Said Edward and Dudley Carle-
ton and Company as the Said Edward Batson by theire Attorneys afforesaid
And the Jurors thereon Impanelled being Called Likewise Came (Viz.)

James Stoddart, foreman, Hugh Ryley, John Browne, John Cozens, William

Selby, Archable Edmonson, James Moore, Edward Willett, Francis Marbery,

William Rothery, John Chittam, Joseph West. Sumoned per Thomas Green-

feild, Sheriffe.

[186] Who to Speake the truth Conserning the premises Elected tryed and
Sworne doe Say upon their Oath they they find for the Defendant.

Therefore it is Considered that the Said Edward and Dudley Carleton and
Company take nothing by their Said writt but be in mercy for their false Clamor
and that the Said Edward Batson goe thereof without Day It is Likewise Con-
sidered that the Said Edward Batson Recover against the Said Edward and
Dudley and Company his Damages by Occation of the premises to nine hundred
thirty one pounds of tobaccoe to the Said Edward Batson by the discretion of
the Justices here at his Request for his Costs and Charges in this behalfe Sus-
tained According to the forme of the Statute etc. by the Court here Adjudged
etc.
