JUNE, 1697 COURT 203
William Lee tooke his oath that he Attended one day as an Evydence for
Robert Brasheere at the Suite of of Richard Edwards and Allowed thirty lbs. of
tobaccoe.
Joseph Winger made oath that he Attended five Dayes as an Evidence for
Edward Willett against Richard Edwards and Allowed one hundred and fifty
lbs. of tobaccoe.
Richard Edwards plantiffe: Robert Brashere Defendant.
The plantiffe by Cleborn Lomax his Attorney Sues the Defendant in a plea
of trespass upon the Case etc. and hath not procecuted his Said writt etc. There-
fore hee and his pledges of procecuteing be in mercy etc. Lett the names of the
pledges be Sought etc. And the Said Robert Brashere goe thereof without day
etc. It is likewise Considered that the Said Robert Brashere Recover against the
Said Richard Edwards his Damages by Occation of the premises to four hundred
Seaventy five pounds of tobaccoe to the Said Robert Brasheere by the discretion
of the Justices here at his Request for his Costs and Charges in this behalfe
Sustained According to the forme of the Stattute etc. by the Court here
Adjudged etc.
Edward and Dudley plantiffe: Edward Batson Defendant.
Prince Georges County Ss. Edward Batson Late of Prince Georges County
Gentleman was Attached to Answer unto Edward and Dudley Carleton and
Company Merchants of a plea of trespass upon the Case etc.
And whereupon the Said Edward and Dudley and Company by William
Stone their Attorney Complayneth that whereas the Said Edward Batson the 3d
day of March in the yeare of our Lord 1692 [1693] at Charles Towne within
the Jurisdiction of this Court was Indebted unto the Said Edward and Dudley
and Company in the Sume of three thowsand Six hundred Seaventy and Eight
pounds of tobaccoe being Soe much due to the Said Edward and Dudley and
Company from the Said Edward Batson upon ballance of Accounts between
them the Said Edward and Dudley and Company and the Said Edward Batson
as by a pertickeler Account thereof here in Court to be produced more at
Large may Appeare And the Said Edward Batson being [185] Soe Indebted
as aforesaid Inconsideration thereof did Assume upon himselfe and to the Said
Edward and Dudley and Company then and there faithfully promise that he
the Said Edward Batson the Said Sume of 3678 lbs. of tobaccoe to them the
Said Edward and Dudley and Company when he Should be thereunto Requested
would well and truly Content and pay Nevertheless the Said Edward Batson his
promise and Assumption aforesaid not at all Regarding but minding and
fraudulently Intending them the Said Edward and Dudley and Company in
this behalfe Craftily and Subtilly to deceive and Defraud the Said Sume of 3678
lbs. of tobaccoe to the Said Edward and Dudley and Company hath not paid
Although the Said Edward Batson afterwards the day and place aforesaid and
at Severall other dayes and times to doe the Same by the Said Edward and
Dudley and Company was often thereunto Requested but hath hitherto Refused
and Still doth Refuse to the Damage of them the Said Edward and Dudley and
Company of 7000 lbs. of tobaccoe and thereof they bring theire Suite etc.
