JUNE, 1697 COURT 201
Richard Atwood in manner aforesaid being indebted the Said Henry Brent
Inconsideration thereof did Assume upon himselfe and to the Said Richard Att-
wood then and there faithfully promise that he the Said Henry Brent the Said
Sume of 974 lbs. of tobaccoe to the Said Richard Attwood when he Should be
thereunto Requested would well and truly Content and pay Nevertheless the Said
Henry Brent in his Life time his promise and Assumption aforesaid not Regard-
ing but minding and fraudulently Intending the Said Richard Attwood in this
behalfe Craftily and Subtilly to deceive and defraud Neither the Said Henry
Brent in his lifetime nor the Said Ann Since the death of the Said Henry Brent
while She was Sole to whom Administration of all and Singular the goods and
Chatties which were of the Said Henry Brent at the time of his Death in due
forme of Law was Committed nor the Said Richard Marsham and Ann Since the
Marryage between them had and Solemnized the Said Sume of 974 lbs. of
tobaccoe of any part thereof to the Said Richard Attwood have not paid nor have
any of them paid Although the Said Henry Brent in his life time and the Said
Ann Since the death of the Said Henry Brent while She was Sole and the Said
Richard Marsham and Ann after the Marryage between them had and Solem-
nized by the Said Richard Attwood have been often thereunto Requested but
have hitherto Refused and Still doe Refuse to the Damage of the Said Richard
Attwood of 1800 lbs. of tobaccoe and thereof he bringeth his Suite etc.

And the Said Richard Marsham and Ann his wife Administratrix aforesaid by
William Stone theire Attorney Cometh and Defendeth the force and Injury when
etc. and Craveth Lycence here to Imparle untill next Court and it is granted unto
him the Same day is given to the plantiffe alsoe.
Att which Said next Court Came the Said parties by there Attorneys aforesaid
and the Said Richard Attwood prayeth that the Said Richard Marsham and Ann
his wife Administratrix aforesaid to his decleration aforesaid may Answer etc.
And now here at this day to witt the 22d day of June in the yeare of our Lord
1697 the Said Richard Marsham and Ann his wife Administratrix aforesaid by
William Stone theire Attorney Cometh and Defendeth the force and Injury when
etc. and Saith that the Said Henry Brent did not Assume in manner and forme as
the plantiffe in his decleration aforesaid hath Complayned and of this they putts
themselfes upon the Court. William Stone.

[183] The truth of the matter in Controversie betweene the partyes aforesaid
being by the Court here Scene heard understood and Maturely deliberated it is
thereupon Considered that the Said Richard Attwood Recover against the Said
Richard Marsham and Ann his wife Administratrix aforesaid as well the Sume
of nine hundred Seaventy four pounds of tobaccoe his Debt for Damages afore-
said As alsoe the Sume of two hundred and Seaventy Six pounds of tobaccoe to
the Said Richard Attwood att his Request for his Cost and Charges in this
behalfe laid out and Expended by the Court here Adjudged to be Leavyed on
the goods and Chatties which were of the Said Henry Brent at the time of his
death when to the hands of the Said Richard Marsham and Ann his wife Shall
be Administred And the Said Richard Marsham and Ann his wife in mercy etc.
