person or persons in whose hands he Attached Such goods and Chatties aforesaid
that they bee and Appeare at the Said Court to Shew Cause if any he or they
have why the Said goods Soe Attached Should not be Condemned and Execution
thereon had and made etc. and that he had then and there the Said writt etc.
Att which Said fourth Tuesday in March 1696 [1697] the Sheriffe made Returne
of the Said writt of Attachment Endorsed on the back (Viz.) Attached in the
hands of Charles Tracey the Debt and Cost which is 992 lbs. of tobaccoe per
Thomas Greenfeild Sheriffe. And the Said Charles Tracy by Cleborn Lomax his
Attorney Cometh and Defendeth the force and Injury when etc. and Craveth
Lycence to Imparle here untill next Court and it is granted unto him the Same
day is given to the Said William Stone alsoe.
Att which Said next Court (to witt) the 22d day of June 1697 Came as well
the Said William Stone in his proper person as the Said Charles Tracy by Cleborn
Lomax his Attorney And the Said William Stone prayeth that the Said Charles
Tracy to his writt of Attachment Aforesaid may Answer and etc.
And the Said Charles by Cleborne Lomax his Attorney Cometh and defendeth
the force and Injury when etc. And Saith that he Remaineth Debtor to the Said
Montgomery only three hundred thirty two pounds of tobaccoe As by the
Account here Sett downe Appeareth (Viz.)
Charles Tracey Debtor to Hugh Montgomery by bill .................... 800
per Contra Creditt: By ordinary Expences proved by oath .................. 171
By Nonsuite Obtained against the Said Montgomery ...................... 297

And hereupon the Said William Stone Prayeth Condemnation of the Said three
hundred thirty two pounds of tobaccoe the ballance abovesaid etc.
Therefore it is Considered by the Court here that the Said three hundred
thirty two pounds of tobaccoe be Condemned in the hands of the Said Charles
Tracey and that the Said William Stone may have Execution for the Same etc.
Richard Atwood plantiffe: Richard Marsham and Ann his wife Administratrix
of Henry Brent Defendant
Prince Georges County Ss. Richard Marsham and Ann his wife late of Prince
Georges County Administratrix of all and Singular the goods and Chatties which
were of Henry Brent gentleman Deceased who dyed Interstate etc. were Attached
to Answer unto Richard Attwood of a plea of trespass upon the Case etc.
[182] And Whereupon the Said Richard Attwood by Cleborne Lomax his
Attorney Complayneth that whereas the Said Henry in his life time that is to
Say the ninteenth day of September in the yeare of our Lord 1690 at Calvert
County that is to Say at Charles Towne within the Jurisdiction of this Court was
Indebted unto the Said Richard Attwood in the Sume of nine hundred Seaventy
and Four pounds of tobaccoe by a Certaine noate Subscribed with the proper hand
of the Said Henry Brent wherein hee did Oblidge himselfe to pay or Cause to be
paid, unto the Said Richard Attwood or order the full and Just Sume of nine
hundred Seaventy and four pounds of tobaccoe as by the Said noate here in Court
produced more at large may Appeare And the Said Henry Brent to the Said
