his Assent by the Court here Adjudged and the Said William Groome in
mercy etc.

Charles Tracy plantiffe: Thomas Moody Defendant

Prince Georges County Ss. Thomas Moody late of Prince Georges County
Sawyer was Attached to Answer unto Charles Tracy of a plea of trespass uppon
the Case etc.

And whereupon the Said Charles by William Stone his Attorny Complaineth
that whereas the [153] Said Thomas the 23d day of October in the yeare of
our Lord 1696 att Charles Towne within the Jurisdiction of this Court was
Indebted unto the Said Charles in the Sume of three hundred and twenty
pounds of tobaccoe being for Severall Licquors Dyetts and ordinary Accomeda-
tions before and att that time Sold and delivered him the Said Thomas by
the Said Charles as by a pertickeler Account thereof here in Court produced
Relation being thereunto had may more att Large Appeare and the Said Charles
in manner aforesaid being indebted Inconsideration thereof did Assume upon
himselfe and to the Said Charles then and there Faithfully promise that he the
Said Thomas him the Said Charles the Said Sume of 320 lbs. of tobaccoe when
he Should be by the Said Charles thereunto Requested would well and truly
Content and pay Nevertheles the Said Thomas his promise and Assumption
aforesaid not att all Regarding but minding and fraudulently Intending him
the Said Charles in this behalfe Craftily and Subtilly to deceive and defraud
the Said Sume of 320 lbs. of tobaccoe aforesaid or any part thereof to the Said
Charles hath not paid Although the Said Thomas to doe the Same by the Said
Charles afterwards the day and place aforesaid was often thereunto Requested
but the Same to pay hath denyed and Still doth denye to the Damage of the
Said Charles of 800 lbs. of tobaccoe and thereupon he brings his Suite etc.

The plantiffe by his Attorny Sues the Defendant for three hundred and
twenty pounds of tobaccoe due by Account as by Decleration and Account
filed Appeareth and haveing Issued out two writts against the Defendant boath
which was by the Sheriffe of Prince Georges County was Returned that the Said
Thomas Moody was not to be found in his balywick and alsoe have Caused
a Coppy of the Decleration to be Left att the house w[h]ere the Defendant
Last Lived in this County. Whereupon the Said plantiffe by his Attorny prayeth
an Attachment against the goods Chatties and Creditts of the Said Thomas
Moody as well for the Said Sume of three hundred and twenty pounds of tobaccoe
the Debt for Damages aforesaid as alsoe the Sume of four hundred fifty Six
pounds of tobaccoe his Cost and Charges in this behalfe Laid out and Expended
According to Act of Assembly in those Cases made and provided And by the
Court here it is granted unto him etc.
