and directors are "authorized to apply to a justice of
the peace of said county for a warrant to the sheriff
of said county to condemn the same, not exceeding
two acres of land for any one toll-house, and the
same proceedings shall be had as is hereinbefore au-
thorized for the condemnation of property required
for the purpose of construction or repair of said road.

Obstructing
road.

SEC. 7. And be it enacted, That if any person shall
cut, destroy, deface, or remove any mile stone or
finger board, set up by said road company, on the
route of said road, or deposit any earth, stone or
other obstruction on or along said road, or remove
the earth or sand from said road, so as to injure the
same, then such person, so offending, may be indicted
by the Circuit Court for Frederick county, and if
convicted, in said court, shall be fined in the discre-
tion of said court for the use of said road; provided,
that this shall not in any manner interfere with the
right of said president and directors to maintain a
civil suit against any person who may trespass upon
said road and wantonly injure the same.

Establish
rates of toll.

SEC. 8. And be it. enacted, That the said president
and directors of said road company, are hereby au-
thorized and empowered to establish uniform rates
of toll, to be charged all persons using said road,
whether the holders of two hundred dollars of the
stock of said road or not; and anything in said orig-
inal act, or its supplements, inconsistent with this
section is hereby repealed.

Powers.

SEC. 9. And be it enacted, That the said president
and directors of the Frederick City and Catoctin
Mountain Road Company, be and they are hereby
authorized and empowered to construct a turnpike
road from the terminus of their present road, as au-
thorized to be built by the said original act to which
this act is a supplement, at the Spout Spring to the
summit of the Catoctin Mountain, near Hamburg,,
on and over the bed of the present county road, as
now located or as may be hereafter located by the
County Commissioners of Frederick county, as far
as practicable; and they are hereby vested with all
powers granted by their original charter and its sup-
plements, to effect said extension, and are charged
