mitted under the preceding section to be discharged
after the space often days from the date of commit-
ment upon satisfactory proof adduced before him that
said person is wholly unable to pay said fine and for-
feiture and costs; provided said fine do not exceed the
sum of five dollars, in which case the person com-
mitted shall not be discharged by said justice of the
peace, until after the expiration of thirty days from
the time of his commitment.

App'nt bailiff.

SEC. 322. The burgess and commissioners, or a
majority of them, may appoint a bailiff for the said
town, who shall have the same general peace powers
as a constable of Washington county, he shall have
authority to arrest all persons found by him violating
any ordinance of said corporation, or on warrant of
the burgess, and shall be allowed the same costs as
constables are allowed for similar services.

Costs.

SEC. 323. The burgess shall be allowed the same
costs for his services as are allowed to justices of the
peace for similar services.

Appoint clerk

SEC. 324. The burgess and commissioners, or a
majority of them, may appoint a clerk and prescribe
his duties, and may allow him such compensation as
they may think proper.

Make by-laws

SEC. 325. The burgess and commissioners, may
make such by-laws and ordinances as they may deem
expedient for the comfort, health, convenience and
prosperity of the said town and its inhabitants, for
the prevention or removal of nuisances, the prevention
and extinguishment of fires, the preservation of
health and suppression of vice and immorality in the
said town; and copies of all such ordinances shall be
printed and posted up in the most public places in
the said town, and also recorded in a book for -that
purpose by the clerk, and which book shall be in the
keeping of the burgess and open at all times to the
inspection of all persons interested.

Appoint
Treasurer.

SEC. 326. The said burgess and commissioners
shall have power to appoint one of their number
treasurer of said corporation, who shall be the cus-
todian of the corporate funds, and to assign his duties
and responsibilities.
