sided within the town twelve months next proceeding
the election and who have during the year immedi-
ately preceding said election been assessed and paid
taxes on real or personal property in said town.

 

SEC. 317. All elections shall be held and conducted
as shall from time to time be directed by the by-laws
of the corporation not inconsistent with this charter.

SEC. 318. If during the year for which they were
elected, the burgess, assistant burgess or any of the
commissioners shall die, resign, remove from said
town or be non compos mentis, or displaced, the remain-
ing members of the said board of burgess, assistant
burgess and commissioners shall appoint successors
to fill such vacancies.

SEC. 319. The burgess and commissioners may
meet as often as occasion may require upon the busi-
ness of the town, and not less than once in three
months; and the assistant burgess in the absence of
the burgess shall preside at such meetings, and when
the burgess is present, shall have the same power as
a commissioner.

SEC. 320. The burgess and in his absence the as-
sistant burgess, shall have power to issue warrants
commanding the bailiff of said corporation or any
constable of Washington county, to arrest any person
violating any of the ordinances of the said corpora-
tion and have brought before him for trial; he shall
have the same power to summon witnesses and en-
force their attendance, and also the same general
peace powers as a justice of the peace, and in case of
conviction, may impose such fine as the ordinance of
the said corporation shall in such cases provide; and
the person convicted in default of payment, may be
committed to the jail of the county until such fine or
forfeiture be paid, unless discharged under the next
succeeding section.
