construction of the said railroad has been duly com-

 

menced as thereby required; and,

 

WHEREAS, by the third section of the act passed

 

January session, eighteen hundred and seventy-four,

 

chapter three hundred and eighty-nine, amendatory :

Preamble.

of the said charter, it was the intention of the Leg-

 

islaiure to extend the time for the completion of the

 

said railroad for the reasons therein stated, but from

 

an omission in transcribing the said third section of

 

the said act, the said third section became inopera-

 

tive, and it is the Intention of this General Assembly

 

to remedy the said defect and omission, and to ex-

 

tend the time for the completion of the said railroad;

 

now therefore

 

SECTION 1. Be it enacted by the General Assembly of

 

Maryland, That the time for the completion of the

 

said Baltimore and Drum Point Railroad Company,

 

be and the same is hereby extended for the period

of five years from the first day of January next; and

 

that the nineteenth section of the said charter, and

 

the third section of the said act of eighteen hundred

 

and seventy-four, chapter three hundred and eighty-

 

nine, be and the same are hereby repealed; provided,

Proviso.

however, that this extension of the charter of the

 

Baltimore and Drum Point Railroad Company is

 

granted in consideration and with the express con-

 

dition that the president, directors and company of

 

that railroad, shall, without delay, under the hands

 

of the president and directors, and the corporate seal

 

of that company, in due form of law, as shall be pre-

 

scribed by the Attorney General of this State, grant,

 

set over, assign, transfer and deliver to the Treasurer

of this State all the shares of stock and certificate in

shares of stock

the Annapolis and Elk Ridge Company; and all the

 

claims, interest, property and demands, in that com-

 

pany, now held or claimed by the Baltimore and

 

Drum Point Railroad Company, to be held by the

 

said treasurer for the use and benefit of this State,

 

and to be subject to such proceedings at law or

 

otherwise as shall be instituted by the Attorny Gen-

 

eral of the State, to protect the interest and rights of

 

the State in the Annapolis and Elk Ridge Railroad,

 

as a preferred stockholder therein, to the sum of

 

three hundred thousand dollars, and otherwise.
