Penalty.
|
plover, sandpiper, partridge or quail so taken, killed or had in possession the sum of five dollars, and for each of the other birds named above, two dollars.

Unlawful.
|
SEC. 4. And be it enacted, That it shall be unlawful at any time to trap quail or partridge, or to hunt for and kill or capture them between sunset and sunrise; any person violating this section, shall be subject to a fine of twenty dollars.
|
|
Not lawful.
|
SEC. 5. And be it enacted, That it shall be unlawful for any person to offer at any time between the first day of February and the first day of November, any of the birds called quail or partridge, snipe, woodcocks or plover, for sale; any person who shall violate this section, and every corporation, railroad company or express company, and every employee thereof, who shall offer or expose for sale, or shall

Penalty.

have in his or their possession or custody with intent to sell or transport any of said birds, shall upon conviction, suffer a fine of two dollars for each bird so offered for sale, or for transport, or received for transportation, together with all costs of prosecution.

May forbid.
|
SEC. 6. And be it enacted, That any land owner, may forbid the killing of birds or game on the same at any season of the year, by public notice in any newspaper published in the county, or by posting notices on the land, and any person taking or de-stroying birds or game on said land in defiance of said prohibition, shall be subject to the penalty of

Additional fine.

one dollar for each bird or animal so destroyed, in addition to the penalties named in sections three, four and eight.

Wood or summer duck.
|
SEC. 7. And be it enacted, That no person shall kill any wood or summer duck, between the first day of January and the tenth day of September in every year, any person violating this section, shall be subject to a fine of five dollars for each duck killed.

|
Evidence to convict.
|
SEC. 8. And be it enacted, That the possession of any of the birds or game mentioned in the preceding sections, during the time when the taking or killing of them is prohibited by this act, shall be deemed "prima facie" evidence against the person of a violation of the law.
