rels or rabbits into another county or State, under a penalty of twenty-five dollars for each and every offence.

SEC. 3. Be it enacted, That no person shall at any time during the year wilfully destroy the eggs or nests of any such birds as are named in this act, within this county, under the penalty of two dollars for each and every offence.
|
Penalty.

SEC. 4. Be it enacted, That the possession by any person, within the county, of any of the birds mentioned in the first section of this act as shot, trapped, killed, or otherwise destroyed, or the possession by any express or transportation company of any pheasant, partridge, wild turkey, squirrel or rabbits, shall be prima facie evidence to convict under this act.

SEC. 5. Be it enacted, That any person offending against any of the provisions of this act, and being convicted thereof before any of the justices of the peace in Washington county, upon the oath or affir-

mation of one or more witnesses, shall forfeit the fine or fines named in this act, one-half to go to the use of the school fund of said county, and the other half to the use of the informer; and if the offender, after being convicted of the crime, shall refuse to pay the said fine or fines, so imposed by this act, he or they shall be committed to the common jail of said county, for every such offence, for the

space of not less than ten nor more than thirty days; provided, however, that such convictions shall be made within sixty days after committing the offence.

SEC. 6. Be it enacted, That it shall be the duty of the constables of the several, election districts of the county aforesaid, to arrest all persons violating any of the sections of this act, and take them before the nearest justice of the peace, to be dealt with as this act directs.
