shall have. the right to furnish all or a portion of such cars as he or it may require, for the carriage of his or its coal, which cars shall be adapted in size and all necessary particulars for use on said railway or railways, and shall be loaded and unloaded in like manner as other cars used thereon; and it shall be

the duty of said Cumberland and Pennsylvania Railroad Company, to provide the necessary motive power, and to transport the coal therein with the same dispatch, and in all respects in the same manner that said company may transport coal in its own cars or in cars provided by it, and to return such cars so furnished by any person or corporation, after the same shall have been unloaded, free of charge to the place of shipment, with the same dispatch as its own cars; and such cars so furnished by any person or corporation while the same are in use on said railway

or railways, shall be under the exclusive control of said railroad company in all respects, as if the same were its own cars, and shall be subject to the same rules and regulations, but none other, as the cars of the said railroad company employed in the transportation of coal; and every person or corporation so furnishing cars for the transportation of his or its coal over said railway or railways or any part thereof, shall be entitled to and shall be allowed an abatement from the rates of tolls, and transportation herein provided at the rate of one half cent per ton per mile, for every ton of coal transported in cars so furnished by such person or corporation.

Under control

SEC. 4. And be. it further enacted, That the word ton used in this act shall be taken and held to mean a full ton of twenty-two hundred and forty pounds.

Signification of the word "ton. "

SEC. 5. And be it further enacted, That in case the Cumberland and Pennsylvania Railroad Company shall sell, lease or part with the control of said railway or railways or any part thereof, under authority of the General Assembly or otherwise, then the said railway or railways and every part thereof, shall continue to be operated by the persons or body corporate buying, leasing or obtaining control of the same under the several provisions of this act, subject to the rights, duties and obligations herein provided.
