present session of the. General Assembly of Maryland, entitled 'An act to amend the charter of the Cumberland and Pennsylvania Railroad Company, passed at the January session eighteen hundred and forty-nine, chapter four hundred and sixty-nine, ' " be and the same -is hereby repealed, except so far as said act repeals the first section of the act of Assembly passed at the January session eighteen hundred and sixty-eight, chapter fifteen, therein particularly referred to and repealed, and that in lieu and substitution thereof, it is hereby enacted as follows: the

said Cumberland and Pennsylvania Railroad Company is hereby authorized to charge for tolls upon and the transportation of coal and tire brick, transported by said company over and upon its railway or railways in the State of Maryland, now owned, controlled or -operated by said company or which may hereafter be owned, controlled or operated by said company, any sum not exceeding the following rates, that is to say, on all coal transported by said company, when and where the distance of such transportation shall not exceed four miles a rate not exceeding four cents per ton per mile, and not exceeding three cents per ton per mile when and where the distance of such transportation shall be more than four miles, and not exceeding ten miles, and not exceeding two cents per ton per mile when and where the distance of such transportation shall ex-

Provided that the gross charge or toll for the transportation of coal over or upon said railway or railways when and where the distance of such transportation shall exceed four miles, shall not be less than the gross sum hereby authorized to be charged for transportation of coal for a distance of

Proviso.

four miles; and provided further that the charges for toll upon, and the transportation of coal on said railway or railways or any part thereof, shall be uniform and equal at the same rates per ton per mile for the above prescribed distances, subject to the terms of the first proviso in this section, to all persons and corporations furnishing such coal for transportation, and that whenever said railroad company sh^ll make any reduction in the rate per ton per mile, hereby authorized to be charged for toll and transportation, for any one of the distances herein mentioned, a cor-
