CHAPTER 168.

AN ACT to protect fish in the waters of the Wico-
mico river from non-residents.

Not lawful.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That it shall not be lawful for any non-
resident of the State to take or catch fish in any
manner or way in the waters of the Wicomico river
without first obtaining from the Clerk of the Circuit
Court of either Wicomico or Somerset county a li-
cense therefor, which license shall be granted upon
payment to said clerk, for the use of the State of
Maryland, the sum of thirty dollars, said license shall
be in force for one year from date of granting and
shall be confined to the boat or vessel therein named;
any person not a resident of the State, violating this

section, shall upon conviction before any justice of
the peace of the State of Maryland, be subject to a
fine of not less than fifty nor more than one hundred
dollars and forfeit the boat or vessel and nets, seines
or tackle so used in taking fish, the proceeds of said
fine and forfeited property, after payment of officers
fees, to be paid to the Clerk of the Circuit Court of
the county where tried, for the use of the State.

Issue war rant.

SEC. 2. And be it enacted, That upon information
of any person, made to any justice of the peace of
either of said counties, the said justice shall issue his
warrant to some constable or sheriff for the arrest of
persons violating the preceding section and have the
said person or persons brought before him for trial.

Appeal.

SEC. 3. And be it enacted, That any party or parties
against whom any justice of the peace may render
a judgment under this act, either to pay a fine or
condemnation of property, may at any time within
ten days from the rendition of such judgment, appeal
from such judgment to the Circuit Court for said
counties respectively; but no execution or sale shall
