CHAPTER 134.

AN ACT regulating and making lawful the setting
of pound nets in the waters of the Elk, Sassafras
and Bohemia Rivers, and their tributaries in Cecil
county.

SECTION 1. Be, it enacted by the General Assembly of Maryland, That on and after the passage of this act, it shall be lawful for any owner or owners of land bordering upon the waters of the Elk, Sassafras and Bohemia Rivers, and their tributaries, lying and being within the limits of Cecil county, or to whom- soever they may extend the privilege to take or catch	Not lawful.
fish from nets or traps known as pound nets; provided however, that it shall not be lawful to take or catch fish with such pound nets as aforesaid, except in the months of March, April and May of each year; and provided further, that such pound nets shall not ex- tend to or across any channel, nor shall they be so placed as to in anywise obstruct the passage of any vessel or boat, engaged in trading in said waters, nor shall any seine or net be used in that portion of said pound nets that confines the fish, the meshes of which are less than one and a quarter inches square, nor shall any stake or post be used in placing said pound nets of a greater diameter than four inches in the largest part, nor shall such stake or post be permitted to remain in said waters for a longer period than that prescribed in this act, for the placing of said pound nets. SEC. 2. And be it enacted, That this act shall not be construed to permit any person or persons to place such pound nets opposite the shore of any owner or owners of land bordering on said waters, unless the	Not be con- strued.

SEC. 3. And be it enacted, That any person violating the provisions of this act, shall forfeit the seine or nets, and the boat and materials used in fishing the seine, and shall in addition pay a fine of twenty dol-	Shall forfeit.
