same from either shore, beyond or outside the build-
ing line established as aforesaid; and every person
offending against the provisions of this act shall be
deemed guilty of a public nuisance; and, on indict-
ment and conviction in said court, shall be fined a
sum equal to the cost of removing said nuisance,
and shall be confined in the county jail till the said
tine and costs shall be paid; and to enable the court
to determine the amount of the said fine, they shall,
at, the time of the trial, hear evidence of the proba-
ble cost of removing such nuisance; and if any per-
son shall unload, discharge or throw overboard any
ballast, stones, shells, earth, saw-dust or other mat-
ter, or suffer the same to run from their premises
into the said channel or harbor, defined as aforesaid,
or shall fill up or obstruct the navigation of the same,
he or she shall be guilty of a public nuisance, and
shall, on indictment and conviction as aforesaid, be
punished by fine, at the discretion of the court, and
be committed as aforesaid, till the said fine and costs
are paid.

Penalty.

SEC. 7. And be it enacted, That the said commis-
sioners, and their surveyor, if not one of their body,
shall be appointed, shall each be entitled to five dol-
lars per day for each day they may serve as such;
and all other persons employed by said commis-
sioners to aid them in making said survey, and such
other duties required by this act, shall be entitled to
one dollar and twenty-five cents per day each, to be
certified by the said commissioners, and paid as here-
inafter provided.

Compensat'n.

SEC. 8. And be it enacted, That the expenses of the
said commission and survey, the expense of recording
the proceedings, and all other expenses incident to
the commission, not exceeding, in the aggregate,
the sum of two hundred and fifty dollars, shall be
assessed, levied, and paid by the county commis-
sioners of the said county as other county charges
are levied and paid, and one-half of all fines imposed
and collected under the provisions of this act, shall
be paid to the said county commissioners to be ap-
plied to the necessary county expenses, and one-half
to the informer.
