CHAP. 31.

                                LAWS OF MARYLAND.

the state with the different districts of the city of Baltimore, and
greatly promote the convenience of Baltimore county and city;
therefore,

Commissioners
appointed to open
and extend centre-street.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That
Thomas Dixon, George Warner, Jacob Small, Aquila Miles, Jacob
Miller, David Wilson, David Winchester and John Eager Howard,
or a majority of them, be commissioners, who are hereby authorised
and empowered to open, clear and extend, Centre-street,
of at least the present width thereof, from the north side of the reservoir
of the Baltimore Water Company eastward, across Jones's
Falls, until it intersects the first street on the eastern shore thereof;
which said commissioners shall ascertain and fix the damages sustained
by the owner or owners of any lot or lots through which
the said street shall be extended; and if such owner or owners shall
think himself, herself or themselves, aggrieved by the judgment
and determination of the said commissioners, it shall and may be
lawful for him, her or them, to apply to the sheriff of Baltimore
county, who is hereby directed forthwith to summon a jury of
twelve men, uninterested in the extension of said street, to try and
ascertain, on oath, what damages such owner or owners have sustained
by the extension of said street; and if the said judgment of
the said commissioners shall be affirmed, the costs incurred by such
appeal therefrom shall be borne by the said appellant or appellants,
and all the damages, costs, charges and expenses, incurred or produced,
by the opening and extension of said street, shall be paid
by the owners of lots benefitted by the extension of said street;
and the said commissioners, or a majority of them, are hereby directed
to fix and ascertain what portion of said damages, costs and 
expenses, are to be paid by each of the owners of said lots, and
the same is hereby declared to be a lien on the said lots until paid,
and to be recoverable from the said proprietors respectively before
a single magistrate, if not more than ten pounds, by an action for money
had and received, in Baltimore county court, in which this act
of assembly, and the proceedings under the same, may be given in
evidence; and the said commissioners are hereby directed to return
to the office of the clerk of Baltimore county, under their hands
and seals, a statement of the proceedings by them made in virtue
of this act.
Authorised to
build a bridge over
Jones's Falls.
    3.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, be and are hereby authorised to build and erect a
bridge on the said street over Jones's Falls, and that the justices
of the levy court for Baltimore county, at their next annual levy
court, to be assessed and levied upon the assessable property of
said county, the sum of eight hundred dollars, to be paid to the
said commissioners for the purpose of defraying the expenses of
building the said bridge.
