    1806.                                 LAWS OF MARYLAND.

licence or permit, and upon his or their refusal to produce the
same, the said constables shall give information immediately to
some one of the justices of the peace, under the penalty of ten dollars,
to be recovered before a justice of the peace as other small
debts are recovered.

Fines to be applied
towards paying
county charges.
    4.  AND BE IT ENACTED, That all fines imposed by this act shall
be paid to the clerk of the county, who shall account for the same
with the levy court thereof, to be applied towards paying the county
charges.

                                      CHAP. XXXII.
An Act to make public a Road in Prince-George's County.  Lib. TH.
                                       No. 1, fol. 225.
Preamble.     WHEREAS it is represented to this general assembly, by the petition
of sundry inhabitants of Prince-George's county, that it
will greatly conduce to the convenience of the people of that part
of said county, to make public the road leading from Spalding's
tavern to the district of Columbia; and the prayer of the petitioners
appearing reasonable, therefore,
Commissioners appointed
to review
a certain road, &c.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That
John Evans, Francis Tolson and Philip Spalding, be and they are
hereby appointed commissioners, and they, or a majority of them,
are hereby authorised and empowered to review the private road
now leading from Spalding's tavern, in Prince-George's county,
to the district of Columbia, through the lands of Thomas Hawkins
Hanson, and to lay out, survey, mark and bound the same, not exceeding
thirty feet in width, and to make a plot of the said road,
when so laid out, surveyed, marked and bounded, and return the
same, under their hands and seals, to the clerk of Prince-George's
county, to be by him recorded among the land records of the
county; and the levy court of said county, at any meeting after the
said plot shall have been recorded, are hereby authorised and empowered
to appoint a supervisor or supervisors, to keep said road
in repair as other public roads are in said county; and the said
levy court are hereby further authorised and empowered, to levy
and assess, upon the assessable property of said county, at the
time of laying their next county levy, a sum of money in their
opinion sufficient to pay the expense in opening the said road.
To ascertain
damages. 
    3.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall ascertain and value the damages which any
person or persons may sustain through whose land the said road
may pass, by opening and clearing the same, and shall make, and
return to the levy court of Prince-George's county, a certificate of
such valuation, the amount of which shall be levied by said court
on the assessable property of said county, and paid to the person
or persons entitled thereto.
Their allowance.     4.  AND BE IT ENACTED, That the said commissioners be allowed
the sum of two dollars each per day as a compensation for their
services.
Road not to go
through any house
&c.
    5.  AND BE IT ENACTED, That the said road shall not run
through the house, yard, garden, orchard or meadow, or any person
or persons, without the consent of such person or persons.
