CHAP. 88.

                                LAWS OF MARYLAND.

by the said commissioners aforesaid to the clerk of the said
county, to be by him recorded.

Plot of road to be
recorded—levy
authorised.
    3.  AND BE IT ENACTED, That when a plot of said road shall be
returned and recorded as aforesaid, it shall and may be lawful for
the levy court of said county to levy upon the assessable property in
said county a sum of money, such as they shall deem necessary under
all circumstances, and to appoint an overseer to open and clear
said road, agreeable to the plot and certificate aforesaid, who shall
give bond in like manner as other overseers of public roads are directed
to give bond, and shall have the same allowance, and the
said road, when opened and cleared as aforesaid, shall be deemed,
and the same is hereby declared to be thereafter, a public road,
and shall be kept in repair as other public roads in said county.
Allowance to commissioners.     4.  AND BE IT ENACTED, That the commissioners respectively
herein before named shall be entitled to receive two dollars for every
day they shall severally attend to discharge the duties required
by this act, which is hereby directed to be levied, collected and paid,
as other county charges are levied, collected and paid.

                                  CHAP. LXXXIX.
An Additional Supplement to an act, * entitled, An act to extend the
    powers of the Levy Court of Allegany County relative to Roads in
    said County.

Preamble.     WHEREAS by an act passed at November session, seventeen hundred
and ninety-four, chapter fifty-two, power is given to the supervisors
of public roads in Allegany county to summons and compel
all able bodied make persons, above a certain age, to work annually
four days on the public roads in said county; and the drawing
them out the full four days as authorised appearing inconvenient
and unnecessary, therefore,

Proviso.

    2.  BE IT ENACTED, by the General Assembly of Maryland, That 
the levy court of Allegany county shall have power, and they are
hereby directed, annually, at their August meeting, to fix and determine
upon the number of days the respective supervisors by them
appointed shall be authorised to summons or warn all the able bodied
male persons in said county, above the age of sixteen, to assist
in repairing the public roads therein; Provided nevertheless, that
the power hereby given to the levy court as aforesaid, shall not be
considered as authorising the reduction of more than two days of
labour in any one year, and that it shall and may be lawful for every
person who shall be summoned or warned to work as aforesaid,
and for every master or mistress of servants, in lieu of working
on the public roads as aforesaid, to pay to the supervisor of their
district the sum or thirty-seven and an half cents for each and every
day any person shall be summoned or warned to work as aforesaid.

                            This section appears to be repealed by 1807, ch. 58.

    3.  AND BE IT ENACTED, That so much of the act passed at November
session, seventeen hundred and ninety-four, chapter fifty-two,
as is inconsistent herewith, shall be and the same is hereby
repealed.
Acts continued.     4.  AND BE IT ENACTED, That this act, and the act to which this
is a supplement, be and they are hereby continued for and during
the term of four years, and until the end of the next session of assembly
which shall happen thereafter.

        Further continued by 1810, ch. 147, and other annual continuing acts.
